<br />streets leading to the site are designed per city <br />standards and are signalized to provide safe access <br />into and out of the site. The conditions of <br />approval, as well as the applicant's design of the <br />tenant space, will ensure that the establishment <br />remains within the standards of all applicable city <br />codes. <br /> <br />C. The proposed conditional use will comply with each <br />of the applicable provisions of this chapter. <br /> <br />The site's Central Commercial zoning permits the <br />establishment of take-out restaurants, as outlined <br />by Municipal Code section 18.44.090 "Permitted and <br />Conditional Uses in the C District". The proposed <br />restaurant complies with all relevant sections of <br />the zoning ordinance. Granting a use permit to <br />Pizza Hut, Inc. for operating a take-out and <br />delivery only restaurant is consistent with the <br />city's ability to regulate zoning as listed in <br />Municipal Code section 18.124 "Conditional Uses". <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act; <br />and <br /> <br />WHEREAS, the proposed take-out and delivery only restaurant, as <br />conditioned, is appropriate for this site. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />section 1. Approves Case UP-91-48, the application of Forsher & <br />Guthrie/Pizza Hut for a conditional use permit to operate <br />a pizza take-out and delivery only restaurant at an <br />existing building located at 927 Main street, subject to <br />the conditions shown on Exhibit "A" attached hereto and <br />made part of this case by reference. <br /> <br />section 2.
