<br />PLANNING COMKISSION CITY OF PLEASAHTON <br />ALAMEDA COUNTY, CALIFOlUJIA <br /> <br />RESOLUTION NO. PC-gl-S4 <br /> <br />RESOLUTION DENYING A VARIANCE AS FILED UNDER CASE V-91-13 FOR <br />JAMES GRIFFEN <br /> <br />WHEREAS, James Griffen has applied for a variance from the <br />Municipal Code to permit an accessory structure 22' 3" in <br />height where the maximum height permissible is 15', for <br />property located at 1 Roman Eagle Court; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) <br />- Low Density Residential/Open Space District; and <br /> <br />WHEREAS, at their duly noticed public hearing of August 28, 1991, <br />the Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br /> <br />WHEREAS, three findings are required for approval of a variance; <br />and <br /> <br />WHEREAS, the Planning Commission was unable to make the required <br />findings. <br /> <br />NOW, THEREFORE, THE PLANNING COMKISSION OF THE CITY OF PLEASAHTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. Denies Case V-91-13 the application of James Griffen <br />for a variance from the Municipal Code to permit an <br />accessory structure 22' 3" in height where the maximum <br />height permissible is 15', for property located at 1 <br />Roman Eagle Court. <br /> <br />Section 2. This resolution shall become effective 15 days after <br />its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED BY THE PLANNING COMMISSION OF THE CITY OF <br />PLEASAHTON ON THE 28TH DAY OF AUGUST 1991 BY THE FOLLOWING VOTE: <br /> <br />AYES: <br /> <br />Commissioners Horan, Hovingh, McGuirk, Michelotti, and <br />Chairman Mahern <br />None <br />None <br />None <br /> <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />DATE: <br /> <br />August 28, 1991 <br /> <br />ATTEST: <br />
