<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-91-45 <br /> <br />RESOLUTION DENYING THE APPEAL OF MICHAEL PEEL AND DARLENE <br />CRANE AS FILED UNDER CASE AP-91-3 <br /> <br />WHEREAS, at its meeting of May 29, 1991, the Zoning Administrator <br />denied the application of Michael Peel and Darlene Crane <br />for a variance from the Municipal Code to allow the <br />construction of a new home that would encroach within the <br />front and side yard setbacks, to be located at 952 Gray <br />Fox circle; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) <br />- Low Density Residential District; and <br /> <br />WHEREAS, at their duly noticed public hearing of June 26, 1991, <br />the Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the city staff <br />concerning this application; and <br /> <br />WHEREAS, the Planning commission was unable to make all of the <br />findings required to justify the granting of a variance. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />section 1. Denies Case AP-91-3, thereby upholding Zoning <br />Administrator denial of Case V-91-9, the application of <br />Michael Peel and Darlene Crane for a variance from the <br />Municipal Code to allow the construction of a new home <br />that would encroach within the front and side yard <br />setbacks, to be located at 952 Gray Fox Circle. <br /> <br />section 2. This resolution shall become effective 15 days after <br />its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED BY THE PLANNING COMMISSION OF THE CITY OF <br />PLEASAHTON ON THE 26TH DAY OF JUNE 1991 BY THE FOLLOWING VOTE: <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />commissioners Hovingh, Michelotti, and Wright <br />commissioner McGuirk and Chairman Mahern <br />Commissioner Horan <br />None <br /> <br />DATE: <br /> <br />June 26, 1991 <br />
