<br />12. The applicant shall submit a sample of the enhanced paving to <br />be utilized in the circular drive to the Planning Director for <br />review and approval prior to the issuance of a building <br />permit. <br /> <br />13. The owner of Lot 1 shall be responsible for the maintenance of <br />the landscaped area on the Sunol Boulevard side of the <br />soundwall. The responsibility for the maintenance of this <br />area by the owner of Lot 1 shall be included in the project <br />CC&Rs. The developer shall install the water meter for the <br />irrigation lines for this landscape area prior to the <br />occupancy of the first residence on the project site. <br /> <br />14. The applicant shall construct the cul-de-sac and portion of <br />the driveway for Lot 1 (shown as cross-hatched), sufficient to <br />meet the requirements of a Fire Department turnaround, prior <br />to the occupancy of the first residence to be located on the <br />site. Prior to the issuance of building permits for the <br />structure on Lot 1, the developer shall pave a portion of the <br />driveway leading to Lot 3 which will replace the portion of <br />the driveway on Lot 1 as the Fire Department turnaround. <br />These respective driveways must be kept free and clear at all <br />times while they are designated the required turnaround. <br /> <br />15. The portion of the soundwall shown as 8' in height shall be <br />increased to 9' in height, if necessary, in order that the <br />minimum elevation of the top of the soundwall is 383 ft. <br /> <br />16. The developer shall pay the cost of 20 linear feet of 6' high <br />flintstone veneer soundwall to be used toward the future <br />construction of a soundwall along the Sunol Boulevard frontage <br />of the adj acent property owner, Mr. Teixeira, per a prior <br />agreement with the City and Ted Mavridis. <br /> <br />17. The applicant shall pay a pro-rata share of the cost of the <br />street and frontage improvements constructed along Sunol <br />Boulevard per a prior. reimbursement agreement between the City <br />and Ted Mavridis. <br /> <br />18. The developer shall modify the grades of the cul-de-sac to <br />provide a drainage system satisfactory to the city Engineer. <br /> <br />19. The developer shall create a homeowner's association in the <br />project CC&R's which shall be responsible for maintaining the <br />circular entrance drive. The City shall be granted the rights <br />and remedies of the association, but not the obligation, to <br />enforce the maintenance obligation. The City Attorney shall <br />review and approve the proposed CC&R's prior to the <br />recordation of the final map. <br /> <br />Resolution No. PC-91-33 <br />May 8, 1991 <br />
