<br />PLANNING COMMISSION Clfr OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-91-24 <br /> <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT AS FILED UNDER <br />CASE UP-91-4 FOR SUE WHITBECK <br /> <br />WHEREAS, Sue Whitbeck has applied for a conditional use permit to <br />establish a large family day care home (7-12 children) to <br />be located at 5090 Independence Drive; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) <br />- Low Density Residential District; and <br /> <br />WHEREAS, at their duly noticed public hearing of March 27, 1991, <br />the Planning commission considered all public testimony, <br />relevant exhibits and recommendations of the city staff <br />concerning this application; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />A. That the proposed location of the conditional use <br />is in accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br /> <br />Objectives of the zoning ordinance include: <br />protecting existing land uses from inharmonious <br />influences and harmful intrusions; fostering <br />harmonious, convenient, workable relationships <br />among land users; and insuring that public and <br />private lands ultimately are used for the purposes <br />which are most appropriate and beneficial to the <br />City as a whole. As conditioned, the proposed <br />large family day care would be consistent with <br />these objectives, because it would retain the <br />residential characteristics of the neighborhood due <br />to its limited scale and size. <br /> <br />The subject site is zoned PUD (Planned Unit <br />Development) - Low Density Residential District. <br />Large family day care homes are allowed in single- <br />family residential districts subject to the <br />standards in the Municipal Code. As conditioned, <br />the Code standards are met. Therefore, the use <br />permit for the large family day care is in <br />accordance with the objectives of the zoning <br />district. <br />
