<br />B. That the proposed location of the conditional use <br />and the conditions under which it would be operated <br />or maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br /> <br />The project, as conditioned, will not be <br />detrimental to the public health, safety and <br />welfare because all city traffic, parking, <br />separation, and noise standards, as well as state <br />licensing requirements regarding the physical <br />environment and operational standards will be met. <br /> <br />C. That the proposed conditional use will comply with <br />each of the applicable provisions of the zoning <br />ordinance. <br /> <br />The site's PUD residential zoning conditionally <br />permits the establishment of large family day care <br />homes, as defined by Municipal Code section <br />18.08.090. The proposed use complies with the <br />large family day care standards listed in section <br />18.124.190 of the zoning ordinance, and meets all <br />other relevant sections of the zoning ordinance. <br />Granting a conditional use permit to Ms. Whitbeck <br />for a large family day care home is consistent with <br />the City's ability to regulate zoning as listed in <br />the Municipal Code Chapter 18.124 (Conditional <br />Uses) . <br /> <br />WHEREAS, projects of this nature are statutorily exempt from the <br />requirements of the California Environmental Quality Act; <br />and <br /> <br />WHEREAS, <br /> <br />the proposed use is <br />designation and General <br />Pleasanton. <br /> <br />consistent with the zoning <br />Plan policies of the City of <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />section 1. Approves Case UP-91-4 the application of Sue Whitbeck <br />for a conditional use permit to establish a large family <br />day care home (7-12 children) to be located at 5090 <br />Independence Drive, subject to the conditions shown on <br />Exhibit "A" attached hereto and made part of this case by <br />reference. <br /> <br />section 2.
