<br />or maintained will not be detrimental to the public <br />hea1th, safety, or we1fare, or materia11y injurious <br />to the properties or improvements in the vicinity. <br /> <br />The project, as conditioned, requires the use to be <br />operated in a non-nuisance manner. Suff icient <br />parking, traffic capacity and distance from <br />residential neighborhoods have been provided and <br />the site and building can accommodate the proposed <br />use. The proposed use is located in an area where <br />its users would not create a nuisance to adjoining <br />areas. streets leading to the site are designed <br />per City standards and are signalized to provide <br />safe access into and out of the site. The <br />conditions of approval of the use permit, as well <br />as the applicant's design of the tenant space the <br />use will occupy, will ensure that the establishment <br />remains within the standards of all applicable City <br />codes. <br /> <br />C. That the proposed conditional use will comply with <br />each of the applicable provisions of the zoning <br />ordinance. <br /> <br />The site's PUD zoning conditionally permits the <br />establishment of bars, as defined by Municipal Code <br />section 18.08.028. The proposed use complies with <br />all relevant sections of the zoning ordinance. <br />Granting a conditional use permit to Chevys for <br />serving alcohol after 10: OOpm is consistent with <br />the City's ability to regulate zoning as listed in <br />the Municipal Code Chapter 18.124. <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act; <br />and <br /> <br />WHEREAS, <br /> <br />the proposed use is <br />designation and General <br />Pleasanton. <br /> <br />consistent with the zoning <br />Plan policies of the City of <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />section 1.
