Discussion ensued as to the acceptable height of the house with Chairman Mahem opting for 30' and Commissioner Wright opting for 35'. A motion was made by Commissioner Michelotti, seconded by Commissioner Wright recommending approval of the Negative Declaration and De Minimis finding for Case PUD- 91-12 inasmuch as project approval would have an insignificant adverse effect on the environment. ROLL CALL VOTE AYES: NOES: ABSENT: ABSTAIN: Commissioners Horan, Hovingh, Michelotti, Wright, and Chairman Mahem None Commissioner McGuirk None Resolution No. PC-91-112 was entered and adopted recommending approval of the Negative Declaration and De Minimis finding for Case PUD-91-12 as motioned. ~ A motion was made by Commissioner Michelotti, seconded by Commissioner Wright finding that the proposed PUD rezoning is consistent with the General Plan; making the PUD findings for the proposed development plan as listed in the staff report; and recommending approval of Case PUD-91-12 - rezoning the subject property to the PUD-LDR zoning designation and approving the development plan subject to the conditions listed in Exhibit "B", with the following modifications: . That Condition 3.j. be modified to change the word "and" to "or" in the first sentence; . That Condition 3.k. be modified to read "The building height shall be 30 feet from the highest ridge to the lowest exterior finished grade." . That Condition 6 shall be modified to replace the homeowners Association with a maintenance agreement; . That the frontage road will be realigned and width of all private roads shall be changed from 28' to 20' right-of-way with an 18' paved section; .
