can be planted. He felt that all parties involved were interested in getting the project on the
road by the end of this year.

Commissioner Hovingh questioned Mr. Fairfield as to which of the 20 lots have been sold.

Commissioner Horan asked Mr. Fairfield how soon he expected the new financing to be
complete. Mr. Fairfield indicated that it should be done momentarily.

Chairman. Mahern asked Mr. Fairfield if the purchasers of the lots received the guidelines for
Golden Eagle Farms. Mr. Fairfield indicated they did receive these guidelines.

Commissioner Horan expressed concern with the issue of the various owners being
responsible for putting in their own trees. He discussed at length with Mr. Fairfield the
possibility of the developer being responsible for a performance bond or escrow funds should
the trees not be planted.

Mr. Fairfield indicated that he is willing to work out any solution, and whatever develops
must be worked out with the City; he also felt Mr. Iserson was very knowledgeable with the
case and could work things out. He said it was his understanding that Joe Elliott of the City
is writing up some type of agreement.

.-

Commissioner McGuirk asked Mr. Fairfield how many lots west of Foothill Road are not
sold. Mr. Fairfield said 35 out of 80 lots. Harry McHugh representing Currin and Timm
enumerated the lots.

In response to Commissioner Hovingh's question, Mr. Fairfield replied that reforestation was
supposed to break up the view; there was never a belief that the houses in the project would
become totally obscured from view.

In regard to Chairman Mahern's question about the road to the staging area, Mr. Fairfield
said the road would be required to be completed by July 1992. This is true if the entire
package can be worked out.

Chairman Mahern discussed Condition 6 with Mr. Fairfield and asked if he was in agreement
with it. Mr. Fairfield indicated he could live with the condition but felt some of the owners
of those lots would not be happy with it.

Discussion ensued between Commissioner Hovingh, Mr. Fairfield and Mr. Higdon regarding
the construction of the water tank and its relation to building permits. Commissioner
Hovingh expressed concern that in the event of a fire and if the area was so overbuilt there
was not adequate water, that there might be some degree of responsibility to the City. Mr.
Higdon noted that the Longview water tank provides fire protection to the property in

Minutes Planning Commission September 25, 1991

Page 5

,.

.
