"-

MA TIERS INITIATED BY COMMISSION MEMBERS

1. Commissioner Horan said he felt a request he had made regarding the N. Sycamore Plan
had been misinterpreted. He clarified that he had stated that he wanted a sense of what the
property owners in that area desired. He did not want an extensive surveyor a whole new
look at the situation. Mr. Iserson said he would pass the information on to Wayne
Rasmussen.

2. Commissioner Hovingh noted that at the previous night's DRB meeting the application
for Spieker Partners addressed a request for two additional names of Ethan Allen and Galaxie
Theater on the Rose Pavilion pylon sign. There are already three names on the sign: Cost
Less, Simon's, and Long's. He said the vote was 5-0 against the application; however,
several of the Commissioners expressed a "soft" denial and told the applicant he could appeal
the decision to either the Planning Commission or City Council.

3. Commissioner Hovingh reported that DRB had also reviewed a request for a satellite dish
that had been installed without a permit on top of the Phillies Cheesesteak Restaurant at 310
Main Street. The Board had approved the application on a 3-2 vote. Commissioner
Hovingh felt that approval was going to open up a proliferation of new requests for dishes in
the Downtown area, and also felt they were going against a set policy on satellite dishes.

Commissioner Horan commented that he serves on the Downtown committee and was not
sure how satellite dishes would be addressed as to improvement and historic restoration of
the Downtown area. Commissioner Hovingh and Chairman Mahern both noted they could
see the dish while driving by. Commissioner Horan subsequently made a request to appeal
the Design Review Board decision for Case Z-91-93. Commissioner Hovingh concurred
with the request. For the record, Commissioner Horan felt the request should be in
conformance because of the untold efforts of the Downtown Task Force to get such
circumstances into conformance, as it is in the process of suggesting design criteria for
Downtown.

4. Chairman Mahern asked staff whether Mr. Iserson had information regarding Brandt
" Esser's letter of complaint about abandoned property at 346 W. Angela Street. Mr. Iserson
replied that he did not have this information, but would discuss it with Mr. Swift.

5. Commissioner Horan called attention to a drive-thru Video Store and asked about the
development review process. Mr. Iserson said this site went through the Design Review
Board only as a new structure. He thought this was zoned as C-C (Community Commercial
or straight zoning) and was not a PUD. Under these requirements it goes only to Design
Review Board.

Minutes Planning Commission September 25, 1991

Page 2

I.

.
