<br />Resolution No. PC-91-41 was entered and adopted approving Case UP-91-21 as motioned. <br /> <br />UP-91-22. David and Dolores Sanchez <br />Application for a conditional use permit to operate an automotive body shop at an <br />existing facility located at 3687 Old Santa Rita Road. Zoning for the property is PUD <br />(Planned Unit Development) - C-O (Commercial and Offices) District. <br /> <br />Mr. Pavan presented the staff report recommending approval of Case UP-91-22 subject to the <br />conditions of the staff report. <br /> <br />Discussion ensued regarding the storage of a vehicle as it awaited parts for repair. <br /> <br />Commissioner Horan expressed concern that Condition 9 regarding wrecked or disabled <br />vehicles might create problems for the applicant if an overzealous officer were to cite him <br />for storing a vehicle. Commissioner Wright noted that Condition 2 would take care of that <br />concern. He commented that many times and even in his own case, when a car is taken for <br />repair it must sit and wait for parts or continued body work. <br /> <br />Commissioner McGuirk discussed Condition 4 with staff. Mr. Swift replied that staff was <br />led to believe that the applicant's building has room to store vehicles that are in the process <br />of being worked on, until they are ready to leave the premises. <br /> <br />.~ <br /> <br />THE PUBLIC HEARING WAS OPENED. <br /> <br />David Sanchez, 3430 Arbor Drive, Pleasanton, represented the application. He stated he has <br />read the staff report and had no problem with the conditions. In response to Commissioner <br />Horan's question, he stated he has adequate room to store 15-18 autos and parts inside the <br />building, and they would not have to be outside. <br /> <br />THE PUBLIC HEARING WAS CLOSED. <br /> <br />Commissioner Hovingh wished to change Condition 8 from "Every effort shall be made by <br />the owners to enforce the prohibition....." to "The owner shall enforce the prohibition. .. " . <br />He felt it was more forceful in regard to the owner's responsibility. Staff and Commission <br />had no problem with that change. <br /> <br />A motion was made by Commissioner Hovingh, seconded by Commissioner McGuirk <br />making the required use permit findings, approving Case UP-91-22 subject to the conditions <br />listed on Exhibit B, and approving a blanket use permit for autobody repair shops located <br />within the building located at 3687 Old Santa Rita Road, subject to these same conditions <br />with the following modifications: <br /> <br />~ <br /> <br />Minutes Planning co..ission <br />JUDe 12, 1991 <br /> <br />Page 17 <br /> <br />,. <br /> <br />- <br />
