-- 3 -- SB 435 <br /> <br /> 1 pursuant to this section, will contain at least any one of the <br /> 2 following: <br /> 3 (A) Ten percent of the total units of a housing development for <br /> 4 lower income households, as defined in Section 50079.5 of the <br /> 5 Health and Safety Code. <br /> 6 (B) Five percent of the total units of a housing development <br /> 7 for very low income households, as defined in Section 50105 of <br /> 8 the Health and Safety Code. <br />9 (C) A senior citizen housing development as defined in <br />10 Sections 51.3 and 51.12 of the Civil Code, or mobilehome park <br />11 that limits residency based on age requirements for housing for <br />12 older persons pursuant to Section 798.76 or 799.5 of the Civil <br />13 Code. <br />14 (D) Ten percent of the total dwelling units in a common <br />15 interest development as defined in Section 1351 of the Civil <br />16 Code for persons and families of moderate income, as defined in <br />17 Section 50093 of the Health and Safety Code, provided that all <br />18 units in the development are offered to the public for purchase. <br />19 (2) For purposes of calculating the amount of the density <br />20 bonus pursuant to subdivision (f'), the applicant who requests a <br />21 density bonus pursuant to this subdivision shall elect whether the <br />22 bonus shall be awarded on the basis of subparagraph (A), (B), <br />23 (C), or (D) of paragraph (1). <br />24 (c) (1) An applicant shall agree to, and the city, county, or city <br />25 and county shall ensure, continued affordability of all low-and <br />26 very low income units that qualified the applicant for the award <br />27 of the density bonus for 30 years or a longer period of time if <br />28 required by the construction or mortgage financing assistance <br />29 program, mortgage insurance program, or rental subsidy <br />30 program.
