-- 7 -- SB 435 <br /> <br /> county, or city and county a proposal for the waiver or reduction <br /> 2 of development standards and may request a meeting with the <br /> 3 city, county, or city and county. If a court finds that the refusal to <br /> 4 grant a waiver or reduction of development standards is in <br /> 5 violation of this section, the court shall award the plaintiff <br /> 6 reasonable attorney's fees and costs of suit. Nothing in this <br /> 7 subdivision shall be interpreted to require a local government to <br /> 8 waive or reduce development standards if the waiver or reduction <br /> 9 would have a specific, adverse impact, as defined in paragraph <br /> 10 (2) of subdivision (d) of Section 65589.5, upon health, safety, or <br /> 11 the physical environment, and for which there is no feasible <br /> 12 method to satisfactorily mitigate or avoid the specific adverse <br /> 13 impact. Nothing in this subdivision shall be interpreted to require <br /> 14 a local government to waive or reduce development standards <br /> 15 that would have an adverse impact on any real property that is <br /> 16 listed in the California Register of Historical Resources. <br /> <br />21 t~,c _.t.__..: ...... : ..... . ..... ~-, ....:'~-':~'(J) For the <br />22 purposes of this chapter, "density bonus" means a density <br />23 increase over the otherwise maximum allowable residential <br />24 density under the applicable zoning ordinance and land use <br />25 element of the general plan as of the date of application by the <br />26 applicant to the city, county, or city and county. The applicant <br />27 may elect to accept a lesser percentage of density bonus. The <br />28 amount of density bonus to which the applicant is entitled shall <br />29 vary according to the amount by which the percentage of <br />30 affordable housing units exceeds the percentage established in <br />31 subdivision ~ -- "'-" ...... <br /> (b~,, ,, ........... <br /> 32 (1) For housing developments meeting the criteria of <br /> 33 paragraph (1) of subdivision (b), the density bonus shall be <br /> 34 calculated as follows: <br /> <br /> 97 <br /> <br /> <br />
