EXHIBIT <br /> <br /> CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, ALAMEDA <br /> <br /> RESOLUTION NO. 05-000 <br /> <br /> RESOLUTION APPROVING THE ABANDONMENT OF A PUBLIC SERVICE <br /> EASEMENT ALONG THE SOUTHERLY SIDE OF PARCEL 3 AND A SMALL <br /> PORTION OF PARCEL 4, PARCEL MAP 4779 AND ACCEPTANCE OF A STORM <br /> DRAIN EASEMENT ALONG THE NORTHERN SIDE OF PARCEL 3, PARCEL MAP <br /> 4779 <br /> <br />WHEREAS, in 1986, Spieker Partners received approval for a Planned Unit Development rczoning <br /> and development plan approval on a 13.3 acre site located at the northwest intersection <br /> of Rosewood Drive and Santa Rita; and <br /> <br />WHEREAS, in 1986, the City of Engineer accepted a grant of easement for public service purposes <br /> (10 foot wide) along the southerly line of Parcel 3 and a small portion of Parcel 4, the <br /> offer of dedication shown on Parcel Map 4779, submitted by Crow-Spieker-Singleton <br /> #112; and <br /> <br />WHEREAS, the City has determined the Public Service Easement (10 foot wide) along the <br /> southerly line of Parcel 3 and a small portion of Parcel 4 is not required; the property <br /> owner has requested the City to formally abandon the easement and has agreed to grant <br /> the City a storm drain easement over the actual location of the drainage system. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS <br />FOLLOWS: <br /> <br />Section 1: The City Council herby approves the attached deed, abandoning the City's public service <br /> easement along the southerly line of Parcel 3 and a small portion of Parcel 4, and <br /> authorizes the City Manager to execute all necessary documents. <br /> <br />Section 2: The City Council herby accepts the attached deed, granting to the City the public storm <br /> drain easement along the northerly line of Parcel 3, and authorizes the City Manager to <br /> accept and record all necessary documents. <br /> <br />Section 3: This resolution shall become effective immediately upon its adoption. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND REGULARLY <br />ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT A MEETING HELD <br />ON JUNE 7, 2005 BY THE FOLLOWING VOTE: <br /> <br /> <br />
