EXHIBIT CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, ALAMEDA RESOLUTION NO. 05-000 RESOLUTION APPROVING THE ABANDONMENT OF A PUBLIC SERVICE EASEMENT ALONG THE SOUTHERLY SIDE OF PARCEL 3 AND A SMALL PORTION OF PARCEL 4, PARCEL MAP 4779 AND ACCEPTANCE OF A STORM DRAIN EASEMENT ALONG THE NORTHERN SIDE OF PARCEL 3, PARCEL MAP 4779 WHEREAS, in 1986, Spieker Partners received approval for a Planned Unit Development rczoning and development plan approval on a 13.3 acre site located at the northwest intersection of Rosewood Drive and Santa Rita; and WHEREAS, in 1986, the City of Engineer accepted a grant of easement for public service purposes (10 foot wide) along the southerly line of Parcel 3 and a small portion of Parcel 4, the offer of dedication shown on Parcel Map 4779, submitted by Crow-Spieker-Singleton #112; and WHEREAS, the City has determined the Public Service Easement (10 foot wide) along the southerly line of Parcel 3 and a small portion of Parcel 4 is not required; the property owner has requested the City to formally abandon the easement and has agreed to grant the City a storm drain easement over the actual location of the drainage system. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: The City Council herby approves the attached deed, abandoning the City's public service easement along the southerly line of Parcel 3 and a small portion of Parcel 4, and authorizes the City Manager to execute all necessary documents. Section 2: The City Council herby accepts the attached deed, granting to the City the public storm drain easement along the northerly line of Parcel 3, and authorizes the City Manager to accept and record all necessary documents. Section 3: This resolution shall become effective immediately upon its adoption. I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT A MEETING HELD ON JUNE 7, 2005 BY THE FOLLOWING VOTE:
