4G <br />THE CITY OF --~ <br /> <br />pL£?tS&NTON Cit ,Council <br /> Staff Report <br /> <br /> June 7, 2005 <br /> Public Works Department <br /> Law Department <br /> <br />SUBJECT: VACATION OF A PUBLIC SERVICE EASEMENT (PSE) WITHIN <br /> ROSE PAVILION (P}IASE III) SHOPPING CENTER <br /> <br />STAFF RECOMMENDATION: <br /> <br /> Staff recommends that the City Council take the following action at the <br /> meeting of June 7, 2005: <br /> <br /> 1. Adopt the attached resolution abandoning the unused Public Service <br /> Easement (PSE) along the southerly side of Parcel 3 and a small portion <br /> of Parcel 4 of Parcel Map 4779; and <br /> <br /> 2. Accept the new grant of easement for storm drain purposes. <br /> <br />SUMMARY: The City received a request to abandon an unused Public Service Easement <br /> (PSE) along the southerly side of Parcel 3 and a small portion of Parcel 4 of <br /> Parcel Map 4779 to allow for the construction of a new 28,550 square-foot <br /> single-story retail building (Broyhill) in the Rose Pavilion Shopping Center. <br /> Staff has investigated the purpose of this easement and determined that there <br /> are no City utilities located with this easement, nor is it likely that the <br /> easement will be needed for utilities in the future since all the infrastructure <br /> serving the shopping center has been in existence for over ten years. <br /> <br />Honorable Mayor and Members of the City Council: <br /> <br />BACKGROUND <br /> <br />Ware Malcomb Architects and Planning, on behalf of Broyhill Furniture, received Planning <br />Commission approval to demolish the currently vacant Galaxy Theater building and replace it <br />with a new 28,550 square foot one-story building for the Broyhill Home Collections store in the <br />Rose Pavilion Shopping Center. <br /> <br /> SR 05:122 <br />Page 1 of 2 <br /> <br /> <br />
