ATTACHMENT 3 <br /> I Y&IIBIT R <br /> <br /> CITY COUNCIL OF THE CITY OF PLEASANTON <br /> ALAMEDA COUNTY, ALAMEDA <br /> <br /> ORDINANCE NO. <br /> <br /> AN ORDINANCE APPROVING THE APPLICATION OF ALAMEDA <br /> NEW COMMUNITIES FOR PLANNED UNIT DEVELOPMENT MAJOR <br /> MODIFICATION, AS FILED UNDER CASE PUD-99-1-3M <br /> <br />WHEREAS, Alameda New Communities has applied for a major modification to an <br /> approved Planned Unit Development (PUD) development plan to allow <br /> solid fencing along the side and/or rear yard property lines of 4476 Tosca <br /> Court, 4462 Tosca Court, 8012 Oak Creek Drive, 8024 Oak Creek Drive, <br /> 8015 Oak Creek Drive, 8031 Oak Creek Drive, 8045 Oak Creek Drive, <br /> 4526 River Rock Hill Road, and 4538 River Rock Hill Road, all located in <br /> the Westridge Subdivision (formerly the Lemoine property); and <br /> <br />WHEREAS, PUD-RDR/LDR (Planned Unit Development - Rural Density Residential/ <br /> Low Density Residential) District and, Prior to Planned Unit Development <br /> Rezoning and Development Plan Approval, Located in the West Foothill <br /> Road Corridor Overlay District; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br /> California Environmental Quality Act (CEQA); therefore, no <br /> environmental document accompanies this report; and <br /> <br />WHEREAS, at its meeting of April 27, 2005, the Planning Commission recommended <br /> approval of the modification to the PUD development plan; and <br /> <br />WHEREAS, a duly noticed public hearing was held on June 7, 2005; and <br /> <br />WHEREAS, the City Council finds that the PUD major modification is consistent with <br /> the General Plan policies and the purposes of the PUD ordinance of the <br /> City of Pleasanton; and <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />HEREBY ORDA1N AS FOLLOWS: <br /> <br />Section 1.
