<br />~ PUBLIC HEARINGS <br /> <br />ll.. UP-94-80. Ricardo M. Oliveira <br />Application for a conditional use permit to establish a martial arts studio in tenant <br />spaces 3-S of Building Three of the Oak Hills Shopping Center located at S460 SUDol <br />Boulevard. Zoning for the property is C-N (Neighborhood Commercial) District. <br /> <br />Mr. Swift presented the staff report on the application for a conditional use permit to operate <br />a martial arts studio in Oak Hills Shopping Center. Mr. Swift noted a revised layout was <br />distributed indicating the studio's new location in Suite 7. Staff feels martial art studios <br />operate successfully within neighborhood shopping centers, and staff is recommending <br />approval of the application subject to the attached conditions. Mr. Swift noted a new <br />condition was added that states any future changes in suite locations within the center may be <br />handled administratively by the Planning Director. <br /> <br />Commissioner Hovingh inquired if a martial arts studio had been previously approved in this <br />center. Mr. Swift advised that a dance studio and a veterinarian had been approved. <br /> <br />In response to Commissioner Barker, Mr. Swift advised that the applicant requested a 1 p.m. <br />start time and staff made the hours more liberal. He did not perceive a problem with starting <br />even earlier than 9 a.m., if so desired. <br /> <br />Regarding Condition 10, Chairman Wright inquired if there had been problems with <br />assigning parking spaces in this center. Mr. Swift advised this problem has not occurred in <br />this center, however, in other shopping centers, it is becoming common for store owners to <br />sign the spaces in front of their stores. Citing the Hopyard Village Center where cars are <br />being towed for parking violations, staff wants to make clear that this parking lot is for <br />common use. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />Ricardo Oliveira, 5719 Croydon Avenue, San Jose, represented his application and stated he <br />concurs with the staff report and conditions. Mr. Oliveira advised he appreciates the opening <br />hours of 9 a.m., however, he will not be able to open until 1 p.m. until the school is self- <br />sustaining. <br /> <br />Commissioner Dove asked for clarification on the restroom situation. Mr. Oliveira advised <br />there is one restroom adjoining to both the male and female dressing rooms. He stated there <br />will be locks on both doors, he will make the situation known to all the students, and there <br />will be posted signage.
