<br />~ REVISIONS AND OMISSIONS TO THE AGENDA <br /> <br />Mr. Swift advised that Item 6b. UP-94-35, Bill Currin (Oak Tree Farm) and 6c. UP-94-47, <br />Pleasanton Community Church are continued until the August 10, 1994, meeting. He also <br />advised that 6d. PUD-94-03/UP-94-267, Reynolds and Brown (Orbits Family Entertainment <br />Center) will be continued to the August 24, 1994, meeting. <br /> <br />5. MATTERS CONTINUED FOR DECISION <br /> <br />There were none. <br /> <br />6. PUBLIC HEARINGS <br /> <br />ll. PUD-80-15-5D-4M1UP-94-10. Caffmo. Inc. CEsnresso Exnress) <br />Application for 1) a PUD major modification to Measure "X" - the approved <br />development plan for the Pleasant Village Shopping Center to allow drive-in and <br />take-out establishments, and 2) a conditional use permit approval for a drive-through <br />espresso stand at the Pleasant Village Center located at 6700 Santa Rita Road. Zoning <br />for the property is PUD (Planned Unit Development) - Commercial District. <br /> <br />Mr. Swift presented the application for Caffmo, Inc. to amend the PUD that governs the <br />Pleasant Village Shopping Center to permit a drive-in/take-out establishment and to review a <br />conditional use permit application for a drive-through espresso stand at that site. This <br />shopping center is governed by Measure X. After Measure X passage, the City Council <br />clarified that no drive-in/take-out establishments were allowed in this Center. Staff and the <br />applicant have worked to narrowly define a take-out use that would allow small take-out <br />establishments such as the Caffino, Inc. application. However, for the reasons outlined in <br />the staff report, staff does not feel a take-out establishment can be satisfactorily established <br />within this center at any location, and recommends denial of the PUD modification. <br /> <br />Regarding the conditional use permit application, staff has determined the best location for <br />this espresso stand would take out a large landscaped island. The applicants have done their <br />best to locate their facility to impact the shopping center the least, however, staff does not <br />believe that it has satisfactorily eliminated the potential problems. Staff recommends denial <br />of the conditional use permit as well. <br /> <br />Mr. Swift agreed with Chairman Wright that if the Commission votes for denial of the PUD <br />modification, the conditional use permit application is a moot point. <br /> <br />Chairman Wright and Commissioners McGuirk, Hovingh and Dove stated they had met with <br />and/or spoke with the applicant and representatives. <br /> <br />Brad Hirst, 6280 West Las Positas, #220, represented Caffino, Inc.
