.~ Commissioner Hovingh commented that he feels Buttercup Pantry's request is legitimate. He
has con=rn with the businesses west of the Hopyard-Owens intersection, believing they do
not need to be included in the sign ordinance relaxation.

Commissioner Wright supports the code amendment because the sign relaxation is only
during the construction phase, not after construction is complete and a business suffers a loss
of visibility.

A motion was made by Commi...~ioner Hovingh, seconded by Commi......ioner Wright,
recommending approval of the draft ordinance Exhibit "A," and forwarding the draft
ordinance to the City Council for review.

ROLL CALL VOTE

AYES:
NOES:
ABSENT:
ABSTAIN:

Commissioners Hovingh, Michelotti, Mahem, Wright, and Chairman McGuirk
None
Commissioner Finch
None

Resolution No. PC-94-27 was entered and adopted recommending approval of the draft
ordinance Exhibit "A" for Case RZ-94-3 as motioned.

~

Commissioner Wright believes the businesses on Owens (west of Hopyard) need not be
included in the relaxation because they have access from other areas.

Commissioner Mahem commented that she would like Johnson Drive eliminated from the
affected area. She feels Hungry Hunter, Denny's, and the gas station could benefit from
additional signage.

Commissioner Michelotti feels the whole area is affected because of the inaccessibility caused
by the closed interchange. Commissioner Michelotti inquired of staff why the Home Depot
retail area was included, and staff feels all of the businesses are affected because they are
being denied patronage due to inadequate accessibility.

Mr. Swift advised that the Commission could eliminate Johnson Drive from the defined
affected business area.

Chairman McGuirk clarified that the new boundary would be at the Owens-Johnson Drive
intersection.

A motion was made by Commi......ioner Hovingh, seconded by Commi......ioner Wright,
recommending approval of the attached standards, Exhibit "B," for the I-580IHopyard
Road interchange banners, and amending Exhibit "C" by eliminating the businesses on
Johnson Drive.

Planning Commi..ion Minutes

Page 7

May 25, 1994

.

.
