<br />(i. PUBLIC HEARINGS <br /> <br />lh PUD-91-19-1M. Peter Shutts/Jerrell Thomll~ <br />Application for a major modification to the Planned Unit Development to eliminllte or <br />extend the June 5, 1994, expiration date for the development plan approval. The <br />development plan included the construction of a single-family home on a 1.25 acre <br />portion of an approximately 2.40 acre site located at 5226 Foothill Road. Zoning for the <br />property is PUD (Planned Unit Development) - Low Density Residential District. <br /> <br />Continued to 5/ll/94. <br /> <br />~ AP-94-02 <br />Appeal of a decision of the P1l1nning Director regarding the PUD conformity of proposed <br />private roadway improvements by Mannie Joel and Martha Greist. The existing private <br />road is located on the Moller Ranch, generally west of the Foothill RoadlMuirwood <br />Drive (north) street intersection. Zoning for the property is PUD-Rural/Low Density <br />Residential District. <br /> <br />Mr. Swift presented the staff report outlining the previously approved PUD decisions and the <br />proposed minor improvements to the private road. The proposed road improvements are <br />being appealed by David Glenn, the East Bay Regional Park District, and Lynn Sorensen. <br />Mr. Swift stated that approximately one-third of the road would be improved by the Moller <br />Ranch development project, and the remaining private road would be left as is, unless the <br />property owners chose to make improvements. Staff feels the proposed improvements <br />(leveling areas of the road, paving, and adding a gravel shoulder where feasible) are minor <br />and consistent with the PUD. Therefore, staff recommends the Planning Commission uphold <br />the Planning Director's decision. <br /> <br />In response to Commissioner Wright, Mr. Swift advised the proposed water lines are private <br />lateral lines, and the property owners would have to get City approval for water hookup. <br />Mr. Swift stated the City would inspect the connection at the water meter and at the house, <br />but they would not inspect the water line in the road. <br /> <br />In response to Commissioner Mahem, Mr. Swift stated a water line is approved in the <br />portion of the road on the Moller Ranch property. No water lines have been approved thus <br />far for the private property portion of the road. <br /> <br />Mr. Beougher clarified for Commissioner Mahem that a water line is being constructed for <br />Ms. Sorensen in conjunction with the Garms property development. She presently has a <br />spring box well system. Her water source will not be affected by the decision of this appeal, <br />nor does she use this particular private road. <br /> <br />Commissioners Hovingh, Michelotti, Mahem, and Wright stated for the record that they had <br />either visited the property or had telephone conversations with Ms. Greist. <br /> <br />Planning Commission Minutes <br /> <br />Page 2 <br /> <br />April 27. 1994 <br /> <br />" <br /> <br />. <br />
