<br />~ <br /> <br />Mr. MacDonald noted that another issue of concern is Condition 17, regarding storm drain <br />lines. The applicant would like to either delete the last sentence or d to the end of the <br />sentence "to the extent this is consistent with the Fish and Game D ment. " <br /> <br />In response to Commissioner Michelotti's question concerning drive ay access to Foothill <br />Road, Mr. Swift indicated that originally lots directly abutted the rig t of way. Current <br />confIguration has an open space buffer between the lots and the road Staff would like the <br />final map to show the buffer with no access. Staff feels that Dr. Gl nn's access is covered <br />by Condition 5. Mr. Swift would like to modify Condition 27 to sa "any new lots" will not <br />have access to Foothill Road and leave Condition 5 unchanged. Mr. MacDonald stated that <br />he would agree with the modification to Condition 27. <br /> <br />Commissioner Hovingh questioned the urgency of approving the Te tive Map and asked if <br />the Planning Commission could act on the Tentative Map after the C ty Council has made a <br />determination on the PUD. Mr. MacDonald indicated that any signi cant change to the <br />PUD at the Council level must be referred back to the Planning Co mission. Mr. Swift <br />noted that the Tentative Map approval is contingent upon PUD appr val. <br /> <br />~ <br /> <br />Dr. David Glenn, 5650 Foothill Road, indicated he has no problem ith the development <br />except with his easement. He referenced a letter dated March 23, 1 3, (copies of which <br />were provided to the Planning Commission this evening) which refe ed to a legal document <br />issued by the Alameda County Superior Court, dated March 22, 198 ,granting him <br />easement over the Moller property from Foothill Road via a securi gate on Foothill Road. <br />Dr. Glenn would like to have easement "relocated" to a location as stablished in legal <br />documents. He advised that the Mollers don't want to agree to the hange. <br /> <br />Dr. Glenn stated that he believes there are no signifIcant traffIc safe issues related to the <br />easement onto Foothill Road. He believes his usage is not hazardou. He feels he is being <br />inconvenienced if he must drive south on Foothill to Muirwood to ake a U-turn in order to <br />head into Dublin. <br /> <br />In response to Commissioner Michelotti's question, Dr. Glenn stat that his main objection <br />is the inconvenience to him. <br /> <br /> <br />Mr. Swift stated that there is a proposed median in Foothill Road d staff will not support a <br />break in the median to allow a left turn out of that easement locatio if the Planning <br />Commission leaves the easement in as part of the approval. <br /> <br />Dr. Glenn said that he would have to use B Court access if he were going toward Dublin, <br />but coming back, he could use his easement access road. It would ut his inconvenience by <br />50%. Dr. Glenn would like to see a break in the median to allow left turn. <br /> <br />Dr. Glenn said he would like a security gate to keep the public out us lessening the fire <br />danger. He believes that anything that can be done to reduce fIre h d is certainly <br />warranted, and a security gate as far forward as possible would g tly reduce the safety <br />hazards. <br /> <br />PJanning Commission Minutes August 11, 1993 <br /> <br />Page 6 <br />
