<br />Commissioner Michelotti asked Ms. Mullen why she is choosing to have her business in her <br />home rather than in an office building. Ms. Mullen stated that she has just recently gotten <br />out of school and has not yet built up a clientele. She needs to av d the high overhead of an <br />office until she establishes her business. <br /> <br />Commissioner Michelotti asked Ms. Mullen if she works with phys cians. Ms. Mullen said <br />that she does not at the present time, but does intend to look into t aspect of business. <br /> <br /> <br />Chairman Hovingh asked the applicant how long it would take to b ild up her business <br />enough to warrant an office elsewhere. Ms. Mullen said she did n know how long it <br />would take. <br /> <br />Commissioner McGuirk asked the applicant if she has approached h r homeowners' <br />association regarding the issue. Ms. Mullen said she did write the a letter and asked them <br />to let her know when a meeting might take place to address the issu. She stated, however, <br />that she had not heard a response from the Board. <br /> <br />Commissioner Michelotti asked Ms. Mullen if she has talked to her mmediate neighbors <br />about the matter. Ms. Mullen said she had not spoken to her neigh ors about the matter, <br />feeling that it was best to approach the matter through the legal proc sses first. <br /> <br />Commissioner McGuirk asked Ms. Mullen if she has approached th police department about <br />any legal requirements. Ms. Mullen said that she has talked to the lice department about <br />their approval process and that approval should take from six to eigh weeks. <br /> <br />Dallas R. Pittman, 8185 #4 Arroyo Drive, President of the Board of Directors of the Laguna <br />Vista Homeowners' Association, said the Board met on February 10 d thought that Ms. <br />Mullen was aware of the meeting. He said the Board voted unanim sly to deny the request. <br />He read from the CC&R's that home occupations are not allowed in e complex. He <br />further stated that he knew of no other businesses, exempt or non-ex mpt in the complex. <br /> <br />In response to a question from Commissioner McGuirk, Mr. Swift re lied that he has <br />checked the exempt occupations for the last two years in the complex and there are now at <br />least 20 home exempt occupations in the complex. <br /> <br />Mr. Pittman expressed concern that liability insurance could be a fact r in not allowing non- <br />exempt home occupations, noting that they have already had one law it because of a child <br />falling off a bike. <br /> <br />In response to Commissioner Wright's question, Mr. Pittman replied hat should the Planning <br />Commission approve the application tonight, then the Board of Direct rs would have to take <br />some sort of civil action. <br /> <br />Planning Commission Minutes February 24, 1993 <br /> <br />Page 3 <br />
