<br />~ <br /> <br />Item 4.b. <br /> <br />MATTERS INITIATED BY OMMISSI N <br /> <br />Commissioner Mahern thanked Joe DeTata for checking on the situa 'on at the RV location <br />on Pimlico Drive. She noted that she had been concerned because ere had been about 40 <br />RV's there, but apparently they were moved after only a day. <br /> <br />Item 5. <br /> <br />PUBLIC HEARINGS <br /> <br />Item 5.a. UP-92-68. Kimberlev Mullen <br />Application for a non-exempt home occupation permit to operate an in-home therapeutic <br />massage service with a maximum of ten clients per week, in one oom of a residence <br />located at 8003 #4 Arroyo Drive. Zoning for the property is RM 25 District. <br /> <br />Mr. Swift presented the staff report recommending approval of Case UP-92-68 subject to the <br />conditions of the staff report. He called attention to a letter handed ut tonight from the <br />Laguna Vista Homeowners Association in opposition to the applicati n. <br /> <br />In response to Commissioner McGuirk's question, Mr. Swift replied that the difference <br />between exempt and non-exempt home occupations are that exempt cupations do not allow <br />clients or deliveries to the home; also exempt occupations limit the s' e and kind of <br />occupations, which would primarily be things like crafts and office-t occupations, such as <br />bookkeeping. <br /> <br />Commissioner Michelotti asked if there are any other non-exempt bu iness operations in the <br />complex that have clients coming to the home. Mr. Swift replied th t he did not know of <br />any; however, there are approximately 20 exempt businesses in the c ndominium complex. <br /> <br />Commissioner Mahern asked how the Planning Commission's decisi n might be affected by <br />the CC&R's. Mr. Swift responded that the City operates independe tly of the CC&R's, <br />even though they try to work with the CC&R's of an association. S ff has asked Ms. <br />Mullen to check into the CC&R's to see what the requirements are. <br /> <br />THE PUBLIC HEARING WAS OPENED. <br /> <br />Kimberley Mullen, 8003 #4 Arroyo Drive, represented the applicatio . She stated that she <br />has read the staff report and conditions and does not have anything t add at this time. <br /> <br />Commissioner Mahern asked Ms. Mullen if she had read the letter f m the homeowners' <br />association. Ms. Mullen affirmed that she has read the letter.
