~ THE PUBLIC HEARING WAS OPENED.

David Jones, 1605 Rose Avenue, represented the application. He s he was not sure
where to start in his description of the project since the process s back in 1982 when he
and his father asked for rewning. In 1988 they were able to build ee houses on Rose
Lane. He indicated the problem is with getting access permission fr m the Fairgrounds to
hook into the future sewer line when it links to the Valley Avenue li e. He stated that
without approval from the Fairgrounds for that line, they cannot serv ce the lots. He said he
has nothing in writing from the Fairgrounds that he will receive s. He commended
Greg Plucker of the Planning Department for his assistance.

Chairman Hovingh questioned Mr. Higdon as to the status with the airgrounds. Mr.
Higdon replied that a temporary sewer line is in place from Fair S eet to the Fairgrounds.
The long-term desire for the City is to minimize or eliminate that se er that must go through
the Fairgrounds, and take the sewage from this area out to Valley A enue. Martinque was
negotiating with the Fairgrounds to have both emergency access and wer/water
connections. They were in final negotiations when they decided not 0 continue the project.
It is still on the City's Master Plan that the water needs to be looped to Valley Avenue; also
the sewer line, at least from Rose Lane, will be looped to Valley Av nue. In the meantime,
the City is allowing development, if it occurs ahead of the infrastruc re development, to
temporarily go through the Fairgrounds.

In response to Commissioner Michelotti's question regarding the M 'nque project, Mr.
Swift and Mr. Beougher explained that the wning PUD is in place; eir Growth
Management approval lapsed when they did not file Final Map; it n w has no likelihood of
being built.

In response to Chairman Hovingh's question, Mr. Swift said the Ci has contacted the
Fairgrounds to make sure that the understanding they had reached w th regard to the
Martinque project was still applicable. Peter Bailey of the Fairgrou ds indicated that it is
still the case.

Ernest Jones, 1725 Rose Avenue, also represented the application. e expressed much
indignation that the Fairgrounds is stating that the Jones must put up a wall between the
Fairgrounds and their property. He said he was definitely not going to put up a wall. He
felt that the Fairground officials should have to appear before the C mmission if they have a
problem to settle with him. He felt the Fairgrounds was trying to g t them to put up a wall,
so they in turn could get access for the water/sewer line. Mr. Jone also expressed
concerned in regard to Condition 17 in that the applicant shall pay a pro-rata share of the
future water and sewer main extension from the project site to Vall Avenue/Koll Center
Parkway. He expressed further concern that the Fairgrounds wants build a trailer court
for Fairground employees and those working there during the fair, d is simply trying to get
adjacent neighbors to pay for the wall. He also expressed concern at the Fairgrounds

Planning Commission Minules January 13, 1993

Page 8
