<br />~ <br /> <br />TIlE PUBLIC HEARING WAS CLOSED, <br /> <br />A motion was made by Commissioner Wright, seconded by Co 'ioner McGuirk <br />approving Case Z-92-140, subject to the conditions listed in Exhi it B, with the <br />following modification: <br /> <br />o Delete Condition 4 and use the darker red color, <br /> <br />ROLL CALL VOTE <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Commissioners Mahern, McGuirk, Michelotti, Wright and Chairman Hovingh <br />None <br />None <br />None <br /> <br />Resolution No. PC-92-83 was entered and adopted approving Case Z 92-140 as motioned. <br /> <br />Item 5,c, UP-92-46, Robert Bvrd <br />Application for a conditional use permit to construct a second un' over a garage of a <br />proposed single-family home located at 4186 Remillard Court. Z ning for the property <br />is PUD (planned Unit Development) - Low Density Residential, dium Density <br />Residential, Open Space District, <br /> <br />.~ <br /> <br />Mr. Swift presented the staff report recommending approval of Case P-92-46 subject to the <br />conditions of the staff report. <br /> <br />Commissioner McGuirk requested clarification regarding Condition 6 <br /> <br />In response to Commissioner Wright's question, Mr. Swift explained that the wording of the <br />State law regarding second units is very ambiguous, and further clari led the issue. At one <br />time it was anticipated that large homes would simply wall off part 0 the house for a second <br />unit; some have been done in other cities, but not in Pleasanton. Th second way to add a <br />unit would be to add onto an existing house by actually making a ho se larger; the third way <br />would be to build a detached structure. Mr. Swift advised that in re d to the proposed <br />application, no matter how a person looks at it, it is a legal unit. <br /> <br />THE PUBLIC HEARING WAS OPENED, <br /> <br />Robert Byrd, 2117 Rheem Drive, represented the application.
