Mr. Swift stated that staff is satisfied with the "Y" connection as it s, but is not opposed to
a different setup if it were more foolproof. He noted that the "Y" easily take care of
how much water goes in either direction. He felt the Commission uld put the matter into a
better perspective by remembering that at the time the PUD was up for approval that nothing
was thought to be of better use for the stream nor was it discussed. Staff feels this is an
Open Space use as long as it is kept in a low-key category as pro sed. He noted that a
small tank is being used; fish and wildlife are assured adequate wa r; and the Fish and
Game Department have no complaints with the situation. He indic ted Mr. Joel is within his
rights to divert the water as is being done.

A motion was made and amended by Commissioner Wright,s onded by Comm;"~ioner
McGuirk, determining that the proposed use is consistent with e designated open
space use approved for this area with PUD-89-13, as long as the criteria as listed in the
staff report are adhered to and accepting Option 1 of the staff port.

AYES:
NOES:
ABSENT:
ABSTAIN:

Commissioners McGuirk, Wright, and Chairman Ho
Commissioner Mahern
Commissioner Michelotti
None

ROLL CALL VOTE

Resolution No. PC-92-62 was entered and adopted recommending proval of the proposed
use for PUD-89-13 as motioned.

MATTERS CONTINUED FOR DECISION

There were none.

MATTERS FOR COMMISSION'S REVIEW

A.
