<br />~ <br /> <br />PUD-91-19. Fred Hemov <br />Application for a PUD development plan approval to construct <br />on an approximately 1.25 acre portion of an approximately 2. <br />5226 Foothill Road. Zoning for the property is PUD (Planned <br />Density Residential District. <br /> <br />ne single-family home <br />acre site located at <br />nit Development) - Low <br /> <br />Mr. Swift presented the staff report recommending denial of Case UD-9l-l9. Staff still has <br />a problem with the density. <br /> <br />THE PUBLIC HEARING WAS OPENED. <br /> <br />Fred Hempy, 5000 Foothill Road, represented the application. He noted that the staff report <br />was excellent and very thorough; however, they had come to a dif erent conclusion than he <br />desired. He gave a history of the PUD, noting that the existing h use used to be a <br />ranchstyle. He has been working with Mrs. Ku and Mr. Thomas n order to create a <br />cohesive development in their area. He felt that from the viewpo' t in a helicopter that the <br />location would appear to be too dense. However, once the trees planted and more <br />mature, he felt the house would barely be seen, if not invisible fro most points. He noted <br />that all necessary studies have been done on the 2.40 acre site and most of it will be open <br />space. The open spaces were a self-imposed decision as he simpl wished to be a good <br />neighbor. <br /> <br />Chairman Mahem pointed out to Mr. Hempy that if his house w the only one on the knoll, <br />that it would not be that bad and staff would not have the concern they do. However, staff <br />is concerned that with the rest of the houses there it will simply too crowded, and she had <br />the same concerns. She asked Mr. Hempy how he would .soften the situation. <br /> <br />Mr. Hempy stated that he felt they could make the house virtuall invisible if they plant <br />landscaping that grows quickly. However, he referred to comme ts made by staff at the <br />Design Review level that nothing he could do or plant would a difference in staff s <br />opinion. He felt this was unfair, and noted that he purposely des' ned the house with a 24 <br />ft. height limit so it could not be seen. <br /> <br />Commissioner Michelotti asked Mr. Hempy if he is the owner or if Mr. Thomas is the <br />owner. Mr. Hempy said Mr. Thomas is actually the owner, but . Hempy is working with <br />him on the project. The home is actually designed for Mr. Hem y. He felt that with the <br />addition of this home, it would help defray some of the cost of i tructure for Mrs. Ku <br />and Mr. Thomas for their own homes. He has been working wi them on this matter. <br /> <br />Commissioner Michelotti noted for the record that she met Mr. <br />main concern is that the home in front of the house that Mr. He <br />"backed" by his home. She asked how Mr. Hempy might mitig <br />replied that he felt the planting of trees would sufficiently mitiga <br /> <br /> <br />empy on the site.
