PUD-91-19. Fred Hem-py
Application for a PUD development plan approval to constroct
on an approximately 1.25 acre portion of an approximately 2.
5226 Foothill Road. Zoning for the property is PUD (Planned
Density Residential District.

Mr. Swift presented the staff report recommending denial of Case
a problem with the density.

ne single-family home
acre site located at
nit Development) - Low

THE PUBLIC HEARING WAS OPENED.

Fred Hempy, 5000 Foothill Road, represented the application. He noted that the staff report
was excellent and very thorough; however, they had come to a di rent conclusion than he
desired. He gave a history of the PUD, noting that the existing ho se used to be a
ranchstyle. He has been working with Mrs. Ku and Mr. Thomas i order to create a
cohesive development in their area. He felt that from the viewpo' t in a helicopter that the
location would appear to be too dense. However, once the trees planted and more
mature, he felt the house would barely be seen, if not invisible fro most points. He noted
that all necessary studies have been done on the 2.40 acre site and ost of it will be open
space. The open spaces were a self-imposed decision as he simply wished to be a good
neighbor.

~

Chairman Mahern pointed out to Mr. Hempy that if his house was e only one on the knoll,
that it would not be that bad and staff would not have the concerns they do. However, staff
is concerned that with the rest of the houses there it will simply be too crowded, and she had
the same concerns. She asked Mr. Hempy how he would "soften" the situation.

Mr. Hempy stated that he felt they could make the house virtually visible if they plant
landscaping that grows quickly. However, he referred to commen made by staff at the
Design Review level that nothing he could do or plant would make a difference in staffs
opinion. He felt this was unfair, and noted that he purposely desig ed the house with a 24
ft. height limit so it could not be seen.

Commissioner Michelotti asked Mr. Hempy if he is the owner or i Mr. Thomas is the
owner. Mr. Hempy said Mr. Thomas is actually the owner, but . Hempy is working with
him on the project. The home is actually designed for Mr. Hempy He felt that with the
addition of this home, it would help defray some of the cost of inf tructure for Mrs. Ku
and Mr. Thomas for their own homes. He has been working with em on this matter.

py on the site. Her
is proposing would be
t feature.
