<br />his case, and that the City does not have the right to try and "hide his facility from the <br />public. <br /> <br />Further discussion ensued as to why Mr. Moss did not comply wi the City regulations. <br /> <br />Chairman Mahern commented that the City, on good faith that Mr Moss would eventually <br />come into compliance with the law, had allowed him to operate illegal recycling center. <br /> <br /> <br />THE PUBLIC HEARING WAS CLOSlm. <br /> <br />Mr. Swift noted that it is not the City's intent to "hide" the recyc' g facility, but in fact, the <br />Code attempts to further the goals of recycling. He further expl . ed that the City has been <br />temporarily allowing recycling facilities which existed prior to ad tion of the recycling <br />ordinance to install the required screening until the City decides if it will apply to the State <br />for exemptions. <br /> <br />Commissioner Michelotti stated that even though she would vote fi r revocation of the use <br />permit, she would strongly recommend that the other recycling ce ters be brought into <br />compliance with the recycling law. <br /> <br />A motion was made by Commissioner Hovingh, seconded by Co <br />revoking the conditional use permit UP-90-76 for a small recyclin <br />comply with the conditions of approval. <br /> <br /> <br />. ssioner Michelotti <br />center due to failure to <br /> <br />ROLL CALL VOTE <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Commissioners Hovingh, McGuirk, Michelotti, and Chairman Mahern <br />None <br />Commissioners Horan and Wright <br />None <br /> <br />Resolution No. PC-92-32 was entered and adopted revoking the nditional use permit as <br />f1led under Case UP-90-76 as motioned. <br /> <br /> <br />The Commission then continued the discussion of Measure K and hy the ridgeland plan <br />should be rejected.
