ii. Any failure to comply with reporting provisions of the policies <br /> shall not affect coverage provided to the CITY, its officers, officials, <br /> employees or volunteers. <br /> <br /> iv. LIFETIME TENNIS's insurance shall apply separately to each <br /> insured against whom claim is made or suit is brought, except with <br /> respect to the limits of the insurer's liability. <br /> <br /> d) LIFETIME TENNIS shall either require each subcontractor, licensee, <br />concessionaire or tenant providing services under this Agreement to procure and to maintain <br />Commercial General Liability and Automobile Liability Insurance in the amounts specified in <br />Subsections (a) and (b), above, or shall insure the activities of subcontractors in the policies <br />specified therein. <br /> <br /> 9.01.2 Workers' Compensation Insurance. During the term of this Agreement, <br />LIFETIME TENNIS shall secure statutory Workers' Compensation Insurance for all <br />LIFETIME TENNIS's employees and Employers Liability Insurance in an amount not less <br />than $1,000,000 per accident, disease or injury, and an endorsement for waiver of subrogation. <br /> <br /> LIFETIME TENNIS shall ensure that all of the employees of any subcontractor, <br />licensee, concessionaire or tenant providing services under this Agreement are similarly <br />covered by workers' compensation and employer's liability insurance. <br /> <br /> 9.01.3 Commercial Crime Insurance. LIFETIME TENNIS shall obtain and keep in full <br />force and effect during the term of this Agreement a commercial crime policy which includes, <br />without limitation, a blanket bond for all employee dishonesty and coverage for theft, <br />disappearance and destruction of monies and securities in or at the Facilities, or outside the <br />Facilities in an amount not less than $50,000. LIFETIME TENNIS shall obtain Director's <br />written permission before individually bonding any individual employee and if allowed shall be <br />in an amount not less than $10,000. <br /> <br /> 9.01.4 Certificates of Insurance. LIFETIME TENNIS shall complete and file with the <br />City Attorney's Office of the City, within fifteen (15) days of its execution of this Agreement, <br />and prior to engaging in any operation or activity set forth in this Agreement, certificates of <br />insurance and endorsements evidencing the coverage's specified above, which shall provide <br />that no cancellation, change in coverage or nonrenewal by the insurance company(s) will be <br />made during the term of this Agreement, without thirty (30) days' prior written notice to CITY. <br />All certificates shall be signed by a person authorized by the insurance company to bind <br />coverage on its behalf. Neither the procuring of insurance by LIFETIME TENNIS nor the <br />delivery by LIFETIME TENNIS to CITY of certificates of insurance evidencing such <br />coverages shall be construed as a limitation of LIFETIME TENNIS's indemnity obligations <br />under Section 9.04 of this Agreement. <br /> <br /> 9.01.5 Inspection of Policies; Change in Coverage Amounts. LIFETIME TENNIS <br />shall permit CITY, at all reasonable times, to inspect any policies of insurance of LIFETIME <br />TENNIS covering risks upon the Facilities.
