<br />Resolution No. PC-93-55 <br />Page 4 <br /> <br />EXHIBIT B <br />Resolution No. PC-93-55 <br />Conditions of Approval <br />Case UP-93-49 <br /> <br />1. That all improvements shall substantially conform to Exhibit <br />"A" - the site and floor plan, dated "R August 20, <br />1993", on file with the Planning Depa except as <br />modified by the following conditions. <br /> <br />2. <br /> <br />That the applicant obtain all the necessa <br />the construction of the secondary unit. <br /> <br /> <br />City permits for <br /> <br />3. Only one residential unit on the subjec property may be <br />rented. The other unit shall be owner-occu ied. With regards <br />to the secondary unit, the unit shall be ccupied by no more <br />than two adults, although there shall b no limit on the <br />number of children. The applicant hall prepare the <br />restriction to this effect and shall sub it it to the City <br />Attorney for review and approval prior to recordation. This <br />shall be accomplished prior to occupancy 0 the second unit. <br /> <br />4. In no case shall the secondary unit be s ld, subdivided or <br />held under different legal ownership from the primary <br />residence. A deed restriction shall be recorded to this <br />effect. The applicant shall prepare the re triction and shall <br />submit it to the City Attorney for review nd approval prior <br />to recordation. This shall be accomplished prior to occupancy <br />of the second unit. <br /> <br />5. The size of the second unit shall be limite to the area shown <br />on Exhibit "A, II approximately 780 square feet. The guest <br />bedroom shall not be occupied, except on a emporary basis not <br />to exceed thirty (30) consecutive days y a guest of the <br />inhabitant of the second unit. No interior wall or other <br />means of physically separating the main un t from the second <br />unit shall be constructed without obtainin a new use permit <br />from the Planning Commission. If the ew use permit is <br />approved, the address of the second unit hall be posted to <br />the satisfaction of the Fire Marshall. deed restriction <br />shall be recorded to this effect. The appl' cant shall prepare <br />the restriction and shall submit it to the City Attorney for <br />review and approval prior to recordatio. This shall be <br />accomplished prior to occupancy of the sec nd unit. <br /> <br />6. Should the occupants of the second unit d space in <br />the garage shall be made available to th occupants.
