PC-93-55 <br /> <br />RESOLUTION APPROVING A CONDITIONAL USE PE <br />CASE UP-93-49, THE APPLICATION OF DORIS C <br /> <br /> <br />ON <br /> <br />IT AS FILED UNDER <br />ALLO <br /> <br />WHEREAS, Doris Caraballo has applied for a con itional use permit <br />to establish a secondary unit within a single-family home <br />at 4977 Forest Hill Drive; and <br /> <br />WHEREAS, zoning for the property is Planned Uni Development (PUD) <br />- Medium Density Residential Distric ; and <br /> <br />WHEREAS, at their duly noticed public hearin of September 22, <br />1993, the Planning Commission cons dered all public <br />testimony, relevant exhibits and rec endations of the <br />City staff concerning this applicatio ; and <br /> <br />WHEREAS, the Planning Commission made the foll wing findings: <br /> <br />A. That the proposed location of t e conditional use <br />is in accordance with the object'ves of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The request to establish a secon unit in the PUD- <br />MDR district conforms with t e objectives and <br />purposes of the zoning ordinan e. The proposed <br />secondary unit would mainta n the physical <br />single-family character of the n ighborhood due to <br />its integration within the pro osed home. When <br />viewed from the exterior, it wou d not be possible <br />to tell that the home contain a second unit. <br />However, there is concern with he maintenance of <br />the single-family lifestyle of the neighborhood. <br />Depending on whether the proper y is sold in the <br />future, the buyer could rent 0 e or both of the <br />dwelling units. This situation c uld impart multi- <br />family characteristics on the eighborhood. In <br />order to prevent this situation from happening, a <br />condition which requires that either the primary <br />residence or the secondary unit be owner-occupied <br />has been included. <br /> <br />B. <br /> <br />The proposed location of the c <br />the conditions under which it wo <br />maintained will not be detrimen <br />health, safety, or welfare, or ma <br />to the properties or improvement <br /> <br />ditional use and <br />ld be operated or <br />al to the public <br />erially injurious <br />in the vicinity, <br /> <br />The following issues should be considered within <br />the scope of the pUblic health, s fety and welfare: <br />
