<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALXFORNXA <br /> <br />RESOLUTION NO. PC-92-81 <br /> <br />RESOLUTION DENYXNG CASE AP-92-13 AND APPROVXNG CASE Z-92-49, <br />THE APPLICATION OF ANDY SALMON, WITH NEW CONDITIONS <br /> <br />WHEREAS, Andy Salmon (Green Scaping/Elder Jerez) has applied for <br />design review approval to retain an existing 238 square <br />foot pavilion with a deck, approximately 11 feet in <br />height located at 2943 victoria Meadow Court; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) <br />- MDR (Medium Density Residential) District; and <br /> <br />WHEREAS, at its meeting of August 11, 1992, the Design Review <br />Board approved Case Z-92-49; and <br /> <br />WHEREAS, within the time specified by the Municipal Code, the <br />decision of the Design Review Board was appealed by <br />concerned neighbors; and <br /> <br />WHEREAS, at their duly noticed public hearing of September 23, <br />1992, the Planning commission considered all public <br />testimony, relevant exhibits and recommendations of the <br />city staff concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act; <br />and <br /> <br />WHEREAS, the Planning commission determined that the pavilion, <br />deck, and stairs as constructed meet all Municipal Code <br />requirements for height, size, and setbacks. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />section 1. Denies Case AP-92-13, and approves, with new <br />conditions, Case Z-92-49, the application of Andy Salmon <br />(Green Scaping/Elder Jerez) for design review approval to <br />retain an existing 238 square foot pavilion with a deck, <br />approximately 11 feet in height located at 2943 victoria <br />Meadow Court, subject to the conditions shown on Exhibit <br />"C" attached hereto and made a part of this case by <br />reference. <br /> <br />section 2. This resolution shall become effective 15 days after <br />its passage and adoption unless appealed prior to that <br />time. <br /> <br />.. <br /> <br />- <br />
