<br />DEVELOPMENT AGREEMENT <br /> <br />THXS DEVELOPMENT AGREEMENT ("Agreement") is made and entered <br />as of this day of , 1992, by <br />and between THE CITY OF PLEASANTON ("city"), a municipal <br />corporation of the state of California, and THE PRUDENTIAL <br />INSURANCE COMPANY OF AMERICA ("Developer"), a New Jersey <br />corporation. <br /> <br />R E C I TAL S <br /> <br />This Agreement is entered on the basis of the following <br />facts, understandings and intentions of the parties: <br /> <br />A. Developer owns certain real property ("Property") <br />located in the city of Pleasanton, county of Alameda, state of <br />California, which is more particularly described in Exhibit "A" <br />attached hereto. The Property is within the area commonly known <br />as the Hacienda B~siness Park. <br /> <br />B. Developer and city executed a development agreement <br />("Phase I Development Agreement"), dated as of December 30, 1983 <br />and recorded January 6, 1984 as Series No. 84-003542, Official <br />Records of Alameda County, pertaining to development of the . <br />initially-developed portion ("Phase I") of the Hacienda Business <br />Park. The Phase I Development Agreement was enacted by the city <br />Council ("city council") as Ordinance No. 1113 on December 6, <br />1983, in accordance with the provisions of Califor-nia Government <br />Code Sections 65864 through 65869.5. Pursuant to the Phase I <br />Development Agreement, Developer was granted the right to develop <br />Phase I in accordance with the provisions of PUD-81-30 ("Phase I <br />PUD"); enacted by the City council as ordinance No. 1109 on <br />November 22, 1983. <br /> <br />C. Developer and city executed a second development <br />agreement ("Phase II Development Agreement"), dated as of April <br />22, 1986 and recorded May 1, 1986 as Series No. 86-103893, <br />Official Records of Alameda county, pertaining to the development <br />of the subsequently-developed portion ("Phase II") of the <br />Hacienda Business Park. The Phase II Development Agreement was <br />enacted by the City Council as Ordinance No. 1247 on March 18, <br />1986, in accordance with the Development Agreement Legislation. <br />Pursuant to the Phase II Development Agreement, Developer was <br />granted the right to develop Phase II in accordance with the <br />provisions of PUD-85-86 ("Phase II PUD"), enacted by the city <br />Council as Ordinance' No. 1246 on March 18, 1986. <br /> <br />The City council adopted Ordinance No. 1325, <br />PUD-81-30-19M/PUD-85-8-3M, hereinafter "PUD" for the purpose of <br />combining into a single document the land use regulations <br />described in the Phase I PUDand the Phase II PUD. <br /> <br />,. <br /> <br />- 1 - <br /> <br />.. <br /> <br />. <br />
