DEVELOPMENT AGREEMENT THXS DEVELOPMENT AGREEMENT ("Agreement") is made and entered as of this day of , 1992, by and between THE CITY OF PLEASANTON ("city"), a municipal corporation of the state of California, and THE PRUDENTIAL INSURANCE COMPANY OF AMERICA ("Developer"), a New Jersey corporation. R E C I TAL S This Agreement is entered on the basis of the following facts, understandings and intentions of the parties: A. Developer owns certain real property ("Property") located in the city of Pleasanton, county of Alameda, state of California, which is more particularly described in Exhibit "A" attached hereto. The Property is within the area commonly known as the Hacienda B~siness Park. B. Developer and city executed a development agreement ("Phase I Development Agreement"), dated as of December 30, 1983 and recorded January 6, 1984 as Series No. 84-003542, Official Records of Alameda County, pertaining to development of the . initially-developed portion ("Phase I") of the Hacienda Business Park. The Phase I Development Agreement was enacted by the city Council ("city council") as Ordinance No. 1113 on December 6, 1983, in accordance with the provisions of Califor-nia Government Code Sections 65864 through 65869.5. Pursuant to the Phase I Development Agreement, Developer was granted the right to develop Phase I in accordance with the provisions of PUD-81-30 ("Phase I PUD"); enacted by the City council as ordinance No. 1109 on November 22, 1983. C. Developer and city executed a second development agreement ("Phase II Development Agreement"), dated as of April 22, 1986 and recorded May 1, 1986 as Series No. 86-103893, Official Records of Alameda county, pertaining to the development of the subsequently-developed portion ("Phase II") of the Hacienda Business Park. The Phase II Development Agreement was enacted by the City Council as Ordinance No. 1247 on March 18, 1986, in accordance with the Development Agreement Legislation. Pursuant to the Phase II Development Agreement, Developer was granted the right to develop Phase II in accordance with the provisions of PUD-85-86 ("Phase II PUD"), enacted by the city Council as Ordinance' No. 1246 on March 18, 1986. The City council adopted Ordinance No. 1325, PUD-81-30-19M/PUD-85-8-3M, hereinafter "PUD" for the purpose of combining into a single document the land use regulations described in the Phase I PUDand the Phase II PUD. ,. - 1 - .. .
