<br />EXHIBIT A <br />Resolution No. PC-92-73 <br />Conditions or Approval <br /> <br />Case UP-92-42 <br /> <br />1. The proposed development shall conform substantially to the <br />site plans, elevations, and related materials, Exhibit "A" <br />(dated "Received August 14, 1992"), on file with the Planning <br />Department, except as modified by these conditions. <br /> <br />2. The developer shall obtain all building and other applicable <br />City permits for the project prior to the commencement of <br />construction. <br /> <br />3. Hours of operation for the lounge and dining room of La <br />Familia Mexican restaurant shall be: <br /> <br />a. <br />b. <br />c. <br /> <br />Sunday - Monday <br />Tuesday - Thursday <br />Friday - Saturday <br /> <br />11:00 a.m. to <br />11:00 a.m. to <br />11:00 a.m. <br />midnight <br /> <br />10:00 <br />11:00 <br />to <br /> <br />p.m. <br />p.m. <br />12:00 <br /> <br />A request to change the hours of operation shall be submitted <br />to the Planning Director for review. The Planning Director <br />may refer the request to the planning Commission for review at <br />a public hearing. <br /> <br />4. No live music or dancing is allowed. <br /> <br />5. Food service, e.g., appetizers, dinner, etc., shall be made <br />available along with the alcoholic beverage service. <br /> <br />6. The resolution for this conditional use permit shall not <br />become effective until the effective date of the ordinance <br />approving the PUD major modification PUD 86-18-3M. If the <br />major modification is denied by the city council, then the <br />conditional use permit shall become void with no further force <br />or effect. <br /> <br />7. The applicant shall maintain the area surrounding the bar <br />tenant space in a clean and orderly manner at all times. <br /> <br />8. The applicant shall be responsible for the conduct of the bar <br />patrons both inside and outside the bar at all times. In the <br />event that nuisances are created through the operation of the <br />bar, either within the bar itself or by its patrons in the <br />vicinity of the bar, the Planning Director may refer the <br />conditional use permit to the planning Commission for review <br />at a public hearing. If necessary, the planning commission <br />may add additional conditions of approval or may revoke the <br />conditional use permit. <br /> <br />.. . r . <br />
