<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-92-72 <br /> <br />RESOLUTION RECOMMENDING APPROVAL OF A MAJOR MODIFICATION TO AN <br />APPROVED PLANNED UNIT DEVELOPMENT TO MODIFY A CONDITION OF <br />APPROVAL AS FILED UNDER CASE PUD-86-18-3M, THE APPLICATION OF <br />CARDOZA PROPERTIES <br /> <br />WHEREAS, Cardoza Properties has applied for approval of a major <br />modification to an approved planned unit development to <br />modify the condition of approval to allow freestanding <br />restaurants serving alcoholic beverages after 10:00 p.m. <br />(classified as a "bar") as conditional uses in the Santa <br />Rita Square commercial center located at 3150, 3160, <br />3170, and 3180 Santa Rita Road; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) <br />_ Commercial District; and <br /> <br />WHEREAS, at their duly noticed hearing of August 26, 1992, the <br />Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the city staff <br />concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act <br />(CEQA) ; therefore, no environmental document was prepared <br />for this report; and <br /> <br />WHEREAS, the Planning commission made the following findings: <br /> <br />1. Serving alcoholic beverages at the Santa Rita <br />Square center past 10:00 p.m. is in the best <br />interests of the public health, safety, and general <br />welfare: <br /> <br />By making alcoholic beverage service till 12: 00 <br />midnight a conditional use, the planning commission <br />can, with its review and approval of the <br />conditional use permit, incorporate measures to <br />ensure that the sale of alcoholic beverages does <br />not become a nuisance to nearby residential <br />properties. <br /> <br />The conditional use permit process enables the <br />Planning Director to bring the project back to the <br />planning commission for further review if it <br />becomes a nuisance. <br /> <br />.. <br /> <br />. <br />
