<br />Introduction <br /> <br />For purposes of these findings, the Kottinger Hills Project, as described in the Final EIR dated <br />July 1992, is referred to as the "project". The Draft Environmental Report on the project dated <br />April 17, 1992, prepared for the City of Pleasanton (City) by the WPM Planning Team, Inc. is <br />referred to as the "DEIR", and the Final EIR on the project dated July 17, 1992 and prepared for <br />the City by the WPM Planning Team, Inc. is referred to as the "FEIR". The FEIR consists of <br />the DEIR, as amended, and response to comments. <br /> <br />This report presents findings that must be made by the City prior to approval of the project to <br />comply with the requirements of Section 21081 of the California Environmental Quality Act <br />(CEQA) and Sections 15091 and 15093 of the CEQA Guidelines. Under CEQA, the City is <br />required to make written findings explaining how it has dealt with each significant environmental <br />impact and each alternative identified in the environmental impact report (EIR). The City may <br />find: <br /> <br />. That changes or alterations have been required in or incorporated into the project to avoid <br />or substantially lessen the significant environmental effects identified in the EIR; <br /> <br />. That such changes or alterations are within the purview and jurisdiction of another public <br />agency and have been or should be adopted by that agency; or <br /> <br />. That specific economic, social, or other considerations make infeasible the mitigation <br />measures or project alternatives identified in the EIR. <br /> <br />Each of these findings must be supported by substantial evidence in the administrative record. <br /> <br />The report is divided into four major sections. Section 1 presents significant impacts of the <br />project that were identified in the EIR, the findings for these impacts and the rationales for the <br />findings. Section 2 presents findings on project alternatives considered in the EIR. Section 3 <br />includes findings for insignificant impacts of the project. Section 4 presents the Statement of <br />Overriding Considerations for significant impacts or issues related to the project that cannot or <br />have not been mitigated or resolved. <br /> <br />The approval of the Kottinger Hills Project is a "project" as defined by CEQA (Public Resource <br />Code 21000 et seq.), requiring preparation of an EIR. The City has prepared and certified an EIR <br />that satisfies the requirements of CEQA. In that EIR, the City identified certain significant <br />adverse impacts that could occur with the approval and implementation of the project. Those <br />impacts are summarized later in this document. <br /> <br />The Draft EIR and Final EIR that were prepared for the project are incorporated in this document <br />by reference, and the reader is referred to them for detailed information on the impacts, mitigation <br />measures, and alternatives. Copies of the documents are available for review at the City Planning <br />Department. For sake of brevity, impacts and mitigation measures listed in this document are <br />summarized.
