<br />PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-92-62 <br /> <br />RESOLUTION DETERKXNING THAT THE WATER DXVERSION AND STORAGE <br />PROPOSED BY MANNIB JOEL/MARTHA GREIST IS CONSISTENT WITH THE <br />DESIGNATED OPEN SPACE USE IN THE A-M HOMES/GARMS RANCH <br />PUD-89-13 <br /> <br />WHEREAS, a lot line adjustment was approved for the transfer of an <br />approximately 3.886 acre parcel of land from the open <br />space area of the A-M Homes/Garms Ranch parcel <br />(PUD-89-13) to Mannie Joel/Martha Griest (owners of an <br />adjacent lot); and <br /> <br />WHEREAS, Mannie Joel/Martha Griest have recently constructed a <br />water system for water diversion and storage on the 3.886 <br />acre parcel; and <br /> <br />WHEREAS, at their duly noticed public hearing of July 8, 1992, the <br />Planning commission considered all public testimony, <br />relevant exhibits and recommendations of the city staff <br />concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act; <br />and <br /> <br />WHEREAS, the Planning Commission determined that the water <br />diversion and storage proposed by Mannie Joel/Martha <br />Griest is consistent with the designated open space use <br />approved for PUD-89-13. <br /> <br />NOW, THEREFORE, THB PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. Makes the determination that the water diversion and <br />storage proposed by Mannie Joel/Martha Griest is <br />consistent with the designated open space use in the A-M <br />Homes/Garms Ranch PUD-89-13 as long as it meets the <br />following criteria: <br /> <br />1) The design of the water system diverting and <br />transporting water from the spring shall remain as <br />presently constructed. The rate of water usage <br />shall not exceed the present diversion rate of 400 <br />- 500 gallons per day. <br /> <br />2) Both sides of the "Y" connector attached at the <br />source of the spring shall always be kept in an <br />open position in order to allow water to flow down <br />into the streambed for access by the wild animals. <br />
