PC-92-56 <br /> <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT AS FILED UNDER <br />CASE UP-92-27 FOR AMERICA'S BEST KARATE, INC./ANTHONY K. CHAN <br /> <br />WHEREAS, America's Best Karate, Inc./Anthony K. Chan applied for <br />a conditional use permit to allow the operation of a Tae <br />Kwon Do martial arts studio in the Amador Plaza Shopping <br />Center located at 1745 Santa Rita Road; and <br /> <br />WHEREAS, zoning for the property is CN (Neighborhood Commercial) <br />District; and <br /> <br />WHEREAS, at their duly noticed public hearing of June 24, 1992, <br />the Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br /> <br />WHEREAS, the Planning commission made the following findings: <br /> <br />1. The proposed location of the conditional use is in <br />accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The proposed Tae Kwon Do studio provides a physical <br />conditioning service that would be available to the <br />residential areas near the Amador Plaza Shopping <br />Center. The Tae Kwon Do studio would be <br />constructed and operated in a manner making it <br />compatible with the other retail/service businesses <br />in the shopping center. Addi tionally, the other <br />businesses in the shopping center could potentially <br />benefit from the presence of the Tae Kwon Do studio <br />in that they offer services and merchandise that <br />would appeal to the Tae Kwon Do students or their <br />parents. <br /> <br />2. The proposed location of the conditional use and <br />the conditions under which it would be operated or <br />maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br /> <br />The practice of Tae Kwon Do does not include the <br />shouting or throwing associated with other styles <br />of martial arts, thus neighboring suites should not <br />be affected by the Tae Kwon Do classes. If the <br />conditional use is permitted, the suite would be <br />properly retrofitted to accommodate the needs of <br />
