<br />PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-92-S1 <br /> <br />RESOLUTION APPROVING CONDITIONS 5 AND 6 OF THE ONE-YEAR <br />EXTENSION OF THE VESTING TENTATIVE TRACT MAP 5721 (KOTTINGER <br />RANCH) <br /> <br />WHEREAS, at its meeting of December 11, 1991, the city of <br />Pleasanton Planning commission approved the application <br />of Westbrook Housing granting a one-year extension of the <br />Vesting Tentative Tract Map 5721 for Phase Three of the <br />Kottinger Ranch development located at the easterly side <br />of Bernal Avenue approximately 100' southerly of <br />Kottinger Drive; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) <br />- Low Density Residential/Medium Density Residential/ and <br />Open Space District; and <br /> <br />WHEREAS, Planning commission approval was subject to six <br />conditions of approval, with the final resolution of <br />Conditions 5 and 6 continued pending resolution of issues <br />relating to public open space easements, staging areas, <br />etc. among staff, the applicant, and representatives of <br />the Kottinger Ranch Homeowners' Association. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. Amends Conditions 5 and 6 for a one-year extension of <br />the Vesting Tentative Tract Map 5721 (Kottinger Ranch) <br />for the property located at the easterly side of Bernal <br />Avenue approximately 100' southerly of Kottinger Drive, <br />as shown below: <br /> <br />Condition 5: An open offer of dedication for a maximum <br />300-feet wide public access trail easement shall be <br />recorded with the Final Map over that portion of Parcel <br />"D" not located in previously approved Final Maps (Tracts <br />5721 and 5875). Final wording shall be to the <br />satisfaction of the Planning Director and the city <br />Attorney. In the event that the City exercises its <br />option to accept the public access easement, the City <br />shall: A) enter into an agreement holding the owner of <br />the portion of Parcel "D" free from liability due to the <br />pUblic use of the area; and B) maintain the physical <br />trail. <br /> <br />Condition 6: Benedict Court shall become a public street <br />with a standard cul-de-sac bulb, but with no designated <br />staging area. <br />
