PC-92-50 <br /> <br />RESOLUTXON DENYXNG CASE AP-92-10, THE APPEAL OF CASE V-92-07, <br />THE APPLICATION OF MICHAEL D. SCHIBLER <br /> <br />WHEREAS, Michael D. Schibler has applied for a variance from the <br />Municipal Code to reduce the required fence setback for <br />a street side yard of the residence located at 4298 <br />Fairlands Drive; and <br /> <br />WHEREAS, zoning for the property is R-1-6,500 (Single Family <br />Residential) District; and <br /> <br />WHEREAS, the Zoning Administrator denied the portion of the <br />variance where the fence encroaches into the five foot <br />setback, beyond the 15 feet length from the residence; <br />and <br /> <br />WHEREAS, within the time specified by the Municipal Code, the <br />applicant submitted an appeal of the decision of the <br />Zoning Administrator to the City of Pleasanton Planning <br />Department; and <br /> <br />WHEREAS, at their duly noticed public hearing of June 10, 1992, <br />the Planning commission considered all pUblic testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act; <br />and <br /> <br />WHEREAS, the Planning Commission was unable to make the findings <br />necessary to approve the portion of the variance denied <br />by the Zoning Administrator. <br /> <br />NOW, THEREFORE, THE PLANNING COMMXSSXON OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. Denies Case AP-92-10, the appeal of the denial of the <br />Zoning Administrator of a portion of Case V-92-07, the <br />application of Michael D. Schibler for a variance from <br />the Municipal Code to reduce the required fence setback <br />for a street side yard of the residence located at 4298 <br />Fairlands Drive. <br /> <br />Section 2. This resolution shall become effective 15 days after <br />its passage and adoption unless appealed prior to that <br />time. <br />
