" PLANNING COMMISSION CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. PC-92-50 RESOLUTXON DENYXNG CASE AP-92-10, THE APPEAL OF CASE V-92-07, THE APPLICATION OF MICHAEL D. SCHIBLER WHEREAS, Michael D. Schibler has applied for a variance from the Municipal Code to reduce the required fence setback for a street side yard of the residence located at 4298 Fairlands Drive; and WHEREAS, zoning for the property is R-1-6,500 (Single Family Residential) District; and WHEREAS, the Zoning Administrator denied the portion of the variance where the fence encroaches into the five foot setback, beyond the 15 feet length from the residence; and WHEREAS, within the time specified by the Municipal Code, the applicant submitted an appeal of the decision of the Zoning Administrator to the City of Pleasanton Planning Department; and WHEREAS, at their duly noticed public hearing of June 10, 1992, the Planning commission considered all pUblic testimony, relevant exhibits and recommendations of the City staff concerning this application; and WHEREAS, projects of this nature are categorically exempt from the requirements of the California Environmental Quality Act; and WHEREAS, the Planning Commission was unable to make the findings necessary to approve the portion of the variance denied by the Zoning Administrator. NOW, THEREFORE, THE PLANNING COMMXSSXON OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Denies Case AP-92-10, the appeal of the denial of the Zoning Administrator of a portion of Case V-92-07, the application of Michael D. Schibler for a variance from the Municipal Code to reduce the required fence setback for a street side yard of the residence located at 4298 Fairlands Drive. Section 2. This resolution shall become effective 15 days after its passage and adoption unless appealed prior to that time.
