That the proposed location of the conditional use <br />and the conditions under which it would be operated <br />or maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br /> <br />The proposed dance instruction to be carried out by <br />the applicant would include background music played <br />at a low volume to facilitate voice instruction, <br />thus neighboring uses should not be affected by the <br />dance classes. If the conditional use is <br />permitted, the suite would be properly retrofitted <br />to accommodate the needs of the students and <br />teachers. Afternoon classes are limited to private <br />instruction having a low parking requirement; the <br />studio should not, therefore, adversely affect the <br />availability of parking spaces in the Downtown. <br />Because group classes -- the heaviest use of the <br />facility -- is anticipated to occur after 6:00 <br />p.m., when most of the existing uses surrounding <br />the studio are not occupied, adequate parking <br />spaces would be available to the dance students. <br /> <br />C. That the proposed conditional use will comply with <br />each of the applicable provisions of the zoning <br />ordinance. <br /> <br />The conditional use is required to comply with all <br />applicable sections of the Municipal Code governing <br />properties zoned Central Commercial. By complying <br />with the recommended conditions of approval, the <br />application would meet the criteria for receiving a <br />conditional use permit and would, therefore, comply <br />with the intent of the Zoning Ordinance. As with <br />any use permit, the permit for this dance studio <br />can be suspended or revoked if the conditions are <br />not met. <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act <br />(CEQA); and <br /> <br />WHEREAS, the Planning commission determined that the proposed <br />conditional use is appropriate for the site. <br />
