Resolution No. PC-93-l3
Page 8

The City shall be granted the rights and remedies of the
association, but not the obligation, to enforce the maintenance
responsibilities of the property owners association. The CC&R's
shall be subject to the review and approval of the city Attorney
prior to recordation of any final map.

7. Areas "A", "B", and "C" shall be subject to the permitted and
conditional uses of the R-l One Family Residential District as
listed under sections 18.32.030 and 18.32.040 of the Pleasanton
Municipal Code, except that multi-family dwellings are allowed
only in Areas "A" and "B".

8. Construction Phasing

a. Any proposed phasing of this development shall be depicted
on the tentative tract map and shall include narrative
explaining the proposed phasing. The City Planning
Director may approve modifications to said phasing plan so
long as satisfactory access is present and other public
safety measures are addressed. Unless otherwise approved
by the Planning Director, the applicant shall complete all
of the on-site improvements in a phase at one time
(including all improvements around future building pads).
All remaining pad areas shall be seeded and kept in a neat
and weed-free manner at all times.

b. with the first construction phase, the developer shall
install the landscape/recreation area improvements in the
ACTC, as shown on the development plan, to a point on the
ACTC concurrent with the eastern leg of "JJ" loop in Area
"C". with construction of any portion of the final 50% of
the overall project (248 units) the developer shall install
the remaining ACTC improvements, and shall remove the
existing chain-link fence between the ACTC and Tassajara
Creek.

The applicant would be reimbursed by the developer(s) of
Hacienda Business Park Lot 60 for their pro-rata share of
the construction costs. If, however, these improvements
are installed by a developer on HBP Lot 60, then the
applicant shall reimburse the Lot 60 developer for this
project's share of the costs.

c. with completion of the ACTC landscape/recreation area
improvements, the developer shall construct a paved
pathway/driveway along the westerly top-of-bank of
Tassajara Creek. The pathway/driveway design shall conform
to City of Pleasanton and Zone 7 standards. All work to be
done in Tassajara Creek requires an encroachment permit
from Zone 7.
