<br />Resolution No. PC-93-11 <br />Page 2 <br /> <br />B. That the proposed location of the conditional use <br />and the conditions under which it would be operated <br />or maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br /> <br />Automobile-related uses are common along Old Santa <br />Rita Road. with conditions regulating the applicant's <br />vehicle numbers, parking, and outdoor uses, the <br />proposed uses can be accommodated without adverse <br />impacts on the other uses in the general vicinity. <br />The applicant can also be required to mitigate future <br />nuisances as a result of the proposed uses. <br /> <br />C. That the proposed conditional use will comply with <br />each of the applicable provisions of the zoning <br />ordinance. <br /> <br />Chapter 18.124 of the Municipal Code (Conditional <br />Uses) states that, because of their unusual <br />characteristics, conditional uses require special <br />consideration so that they may be located properly <br />with respect to their effects on surrounding <br />properties. The proposed business operation and <br />proposed conditions of approval can integrate the <br />proposed uses without detrimentally affecting the <br />surrounding properties or the City in general. The <br />proposed uses will also comply with all provisions <br />and requirements of the city's zoning ordinance. <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act <br />(CEQA); and <br /> <br />WHEREAS, the planning Commission determined that the proposed <br />conditional use permit, as conditioned, is appropriate <br />for the site. <br /> <br />NOW, THEREFORE, THE PLANNXNG COMMXSSXON OF THE CXTY OF PLEASANTON <br />RESOLVES THE FOLLOWXNG: <br /> <br />Section 1. Approves Case UP-93-07, the application of Barry Pries <br />for a conditional use permit to allow used car sales and <br />interior storage of towed vehicles at the existing Santa <br />Rita Towing business located at 3687 Old Santa Rita Road, <br />suite 17, subject to the conditions shown on Exhibit "B" <br />attached hereto and made part of this case by reference. <br /> <br />Section 2. This resolution shall become effective 15 days after <br />its passage and adoption unless appealed prior to that <br />time. <br />
