Resolution No. PC-93-10
Page 2

The location of the home in which the therapeutic
massage is to be conducted is in an RM-25 (multi-
family residential) zoning district. Although
therapeutic massage perhaps has not traditionally
been practiced out of the home in this city, it is
not uncommon to find such services provided in
private homes in other jurisdictions. The small
scale of the proposed business would be such that
additional vehicular traffic, parking demand, or
noise in the neighborhood would be negligible.

Additionally, as with all massage therapy
practitioners, the applicant is required to obtain
a permit to perform massage therapy from the city's
Police Department before the business can be
established. Among other things, this Police
Department permit ensures that the facilities are
appropriate for operating a therapeutic massage
establishment, in accordance with City ordinances
and building regulations. These regulations are in
conformance with the intent and objective of the R-
1 and RM zoning districts.

Therefore, the massage therapy would be conducted
in accordance with Chapter 18.104, and so would
meet the objectives of the zoning ordinance.

B. That the proposed location of the conditional use
and the conditions under which it would be operated
or maintained will not be detrimental to the public
health, safety, or welfare, or materially injurious
to the properties or improvements in the vicinity.

The use would be located in one unit of a four-unit
condominium complex. The area is improved
completely with streets and sidewalks and parking
is permissible along all streets near the unit.
The unit is located toward the front of the
complex, near the main entrance. This location
limits non-resident traffic to the main entrance
and the frontage road, with no need for non-
residents to travel elsewhere through the complex.

The in-home therapeutic massage would not be
detrimental to the public, health, safety or
welfare. Although some additional vehicular or
pedestrian traffic may be created by the
applicant's clients, the hours of operation are
such that it would not interfere with the quiet
morning and evening hours normally associated with
residential districts.

.. -. -
