PC-93-08 <br /> <br />RESOLUTXON APPROVXNG A CONDXTXONAL USE PERMXT AS FXLED UNDER <br />CASE UP-93-01 FOR THE FOUNTAINS RESTAURANT AND CANTINA <br /> <br />WHEREAS, Wade Management Company, Inc. (The Fountains Restaurant <br />and cantina) has applied for a conditional use permit to <br />allow the sale of alcoholic beverages after 10:00 p.m. at <br />a restaurant (classified as a bar) located at 5075 <br />Hopyard Road; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) <br />_ X/C-O (Industrial/Commercial - Office) District; <br /> <br />WHEREAS, at their duly noticed public hearing of February 10, <br />1993, the Planning commission considered all public <br />testimony, relevant exhibits and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, the Planning commission made the following findings: <br /> <br />A. That the proposed location of the conditional use <br />is in accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br /> <br />Some of the objectives of the zoning ordinance are <br />to: foster a harmonious, convenient, workable <br />relationship among land uses, protect existing land <br />uses from incongruous influences and harmful <br />intrusions, and to ensure that public and private <br />lands are used for the purposes which are most <br />appropriate and beneficial to the City as a whole. <br />As conditioned, the proposed restaurant and bar <br />would be consistent with these objectives. <br /> <br />The subject proposal is located in a commercial <br />area of the Hacienda Business Park. Restaurants <br />are permitted uses on the property and bars are <br />conditionally permitted uses on the same, as long <br />as any significant adverse impacts from these uses <br />are eliminated or mitigated. There are no <br />residential areas in close proximity to the <br />property that could be affected by the bar in <br />Fountains. Fountains' bar will not affect the <br />other surrounding retail/commercial uses because of <br />the similarity in the types of uses and the hours <br />of operation. The fact that no loud music or <br />dancing is permitted in the bar will eliminate any <br />noise impacts that the bar may cause after <br /> <br />.. ., . <br />
