<br />Resolution No. PC-93-02 <br />Page 3 <br /> <br />The addition has little effect on the neighbor to <br />the rear (north) because the minimum rear yard <br />setback - 13 feet - is most closely located to this <br />neighbor's garage. The addition has been designed <br />somewhat sensitively with only two, second-story <br />windows on this rear elevation which are located <br />towards the eastern end of the house and would have <br />little impact on the neighbor to the north. Mature <br />trees along this common property line (on the Metz <br />property and the neighbor's property) help to <br />screen the second floor of the addition. <br /> <br />The proposed addition will not have privacy impacts <br />on the neighbors and because the addition would be <br />constructed in conformance with all applicable <br />Building and Fire Code requirements, the proposed <br />addition will not be detrimental to the public <br />health, safety or welfare, or materially injurious <br />to properties or improvements in the vicinity. <br /> <br />WHEREAS, the Planning commission was unable to make the three <br />required findings for the variance to exceed the maximum <br />floor area ratio of 40 percent. <br /> <br />NOW, THEREFORE, THE PLANNXNG COMKXSSXON OF THE CXTY OF PLEASANTON <br />RESOLVES THE FOLLOWXNG: <br /> <br />Section 1. Approves the variance from the Municipal Code to permit <br />construction of a second-story addition within a portion <br />of the required rear yard for an existing residence <br />located at 1533 Harvest Road. <br /> <br />Section 2. Denies without prejudice that portion of the variance <br />to exceed the maximum floor area ratio of 40 percent. <br /> <br />section 3. Recommends that the applicant redesign the plan for the <br />second-story addition and submit the revised plan to the <br />Zoning Administrator for review. <br /> <br />Section 4. This resolution shall become effective 15 days after <br />its passage and adoption unless appealed prior to that <br />time. <br />
