<br />9. The developer shall grant to the city a conservation easement <br />over the 44-acre hillside portion of the site (Lot A). This <br />easement shall indicate that no additional development is <br />permitted on the undeveloped hillside portion of the property, <br />and that the open space is to be maintained in perpetuity, in <br />accordance with General Plan pOlicies and land use designations. <br />(modification of MM 3b [part 1]) <br /> <br />10. The conservation easement shall indicate that the property-owner <br />of Lot A/developer may construct an equestrian facility which <br />includes, but is not limited to: horse stables, riding ring(s), <br />turn-out paddocks, other farm-related structures (for storage of <br />feed, bedding, equipment, etc.), parking areas and an access <br />road which may lead from the private driveway extending past Lot <br />47. These facilities are subject to environmental review and <br />approval by the City through an application for a major <br />modification to the PUD, prior to any grading, vegetation <br />removal, run-off diversion or construction in anticipation of <br />such facilities. <br /> <br />11. The property-owner of Lot A/developer shall grant a public <br />access easement which traverses the hillside open space portion <br />of the site. This access shall grant pedestrian/equestrian <br />right of trail access to the residents of the Oak Tree Farm <br />development. Additionally, the property-owner of Lot <br />A/developer shall grant first right of refusal for use of the <br />equestrian facility to each resident of the Oak Tree Farm <br />development. <br /> <br />12. The developer shall prepare an open space management program for <br />the hillside open space area prior to tentative map approval. <br />The management mechanism shall provide for continued maintenance <br />of emergency vehicle access roads, fencing at the property <br />boundaries and at the residential/open space boundaries. It <br />shall indicate levels of maintenance required, and propose <br />precise boundaries for land and easement dedication, and <br />emergency vehicle access rights-of-way through the open space. <br />This management program shall be administered by the owner of <br />Parcel A. (modification of MM 3f) <br /> <br />13. The developer shall prepare an open space management program for <br />the open space areas along Foothill Road and common landscape <br />areas (such as street median islands) prior to tentative map <br />approval. The management mechanism shall provide for continued <br />maintenance of the open space areas in perpetuity, weed <br />abatement, enforcement of CC&Rs prohibiting construction, etc. <br />within the open space areas, and for continued maintenance of <br />landscape areas to the satisfaction of the city. The program <br />shall indicate levels of maintenance required and shall be <br />administered by the Landscaping and Lighting District. <br />
