<br />:- <br /> <br />PLANNING COMMISSION CITY OF PLEASANT ON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-92-5 <br /> <br />RESOLUTION DENYING THE APPEAL FOR CASE AP-91-10, THEREBY <br />UPHOLDING THE APPROVAL OF CASE V-9l-l8, THE APPLICATION OF <br />JESS C. SPENCER MORTUARIES, INC. <br /> <br />WHEREAS, Jess C. Spencer Mortuaries, Inc. as applied for Zoning <br />Administrator approval for a variance to allow the <br />construction of a building within the required ten foot <br />rear and front yard setbacks, and to allow the <br />construction of a wood trellis within the required 10 <br />foot rear yard setback for an approved mortuary building <br />to be located at 4167 First street; and <br /> <br />WHEREAS, zoning for the property is c-s (Services Commercial) Core <br />Area Overlay District; and <br /> <br />WHEREAS, the Zoning Administrator approved the variance at a <br />public hearing held on November 14, 1991; and <br /> <br />WHEREAS, the decision of the Zoning Administrator was subsequently <br />appealed by a concerned neighbor; and <br /> <br />WHEREAS, at their duly noticed public hearing of January 8, 1992, <br />the Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act; <br />and <br /> <br />WHEREAS, the Planning commission determined that the granting of <br />the variance will not create any adverse impacts on the <br />adjacent properties or neighborhoods in the area due to <br />the location of the site. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />section 1. Denies Case AP-91-10, thereby upholding the decision <br />of the Zoning Administrator approving Case V-91-18, the <br />application of Jess C. spencer Mortuaries, Inc. for a <br />variance to allow the construction of a building within <br />the required ten foot rear and front yard setbacks, and <br />to allow the construction of a wood trellis within the <br />required 10 foot rear yard setback for an approved <br />mortuary building to be located at 4167 First street. <br />
