<br />Resolution No. PC-95-97 <br />Page 6 <br /> <br />21. The developer acknowledges that the City of Pleasanton does not guarantee the <br />availability of sufficient sewer capacity to serve this development by the approval of this <br />case, and that the developer agrees and acknowledges that building pennit approval may <br />be withheld if sewer capacity is found by the City not to be available. <br /> <br />22. This approval does not guarantee the availability of sufficient water to serve the project. <br />The City shall withhold building pennits for the project if at the time building permits are <br />applied for, mandatory water rationing is in effect, unless the City has adopted a water <br />offset program and unless the developer is participating in the program. Notwithstanding <br />the developer's participation in such a program, the City may withhold building permits if <br />the City determines that sufficient water is not available at the time of application of <br />building permits. <br /> <br />BUILDING AND ENGINEERING <br /> <br />23. The applicant shall obtain a building permit and any other applicable City permits for the <br />project prior to the commencement of any construction. <br /> <br />24. All building and/or structural plans shall comply with all codes and ordinances in effect <br />before the Building Department will issue permits. <br /> <br />25. All dwelling units in the development shall be constructed to meet Title 24 State energy <br />requirements. <br /> <br />26. The applicant shall pay a pro-rata share for the undergrounding of the existing overhead <br />utility lines along the east side of Augustine Street. Said payment shall be made to the <br />City Engineer prior to issuance of building pennits for the project. <br /> <br />27. Electric power distribution, gas distribution, communication service, cable television, and <br />any required alarm systems for the existing house and new apartment building shall be <br />installed underground from the development to the east side of Augustine Street in a joint <br />utility trench unless otherwise specifically approved by the City Engineer. Details of said <br />undergrounding shall be subject to final review and approval by the City Engineer prior <br />to issuance of building permits. <br /> <br />28. The applicant shall submit a final grading, utility, and drainage plan prepared by a <br />licensed civil engineer depicting all final grades and on-site drainage control measures, <br />including concrete-lined V-ditches, to protect all cut and fill slopes from surface water <br />overflow. This plan shall be subject to the review and approval of the City Engineer, <br />Planning Director, and/or the Director of Building Inspection prior to the issuance of any <br />building permits. <br /> <br />II <br />
